Requires prisoners in Department of Corrections facilities to wear standardized uniforms and prohibits them access to cable television service. Also prohibits prisoners from using cell phones. LRB9009812RCcd LRB9009812RCcd 1 AN ACT to amend the Unified Code of Corrections by 2 changing Section 3-7-2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended 6 by changing Section 3-7-2 as follows: 7 (730 ILCS 5/3-7-2) (from Ch. 38, par. 1003-7-2) 8 Sec. 3-7-2. Facilities. 9 (a) All institutions and facilities of the Department 10 shall provide every committed person with access to toilet 11 facilities, barber facilities, bathing facilities at least 12 once each week, a library of legal materials and published 13 materials including newspapers and magazines approved by the 14 Director. A committed person may not receive any materials 15 that the Director deems pornographic. 16 (b) (Blank). 17 (c) All institutions and facilities of the Department 18 shall provide facilities for every committed person to leave 19 his cell for at least one hour each day unless the chief 20 administrative officer determines that it would be harmful or 21 dangerous to the security or safety of the institution or 22 facility. 23 (d) All institutions and facilities of the Department 24 shall provide every committed person with a wholesome and 25 nutritional diet at regularly scheduled hours, drinking 26 water, clothing adequate for the season, bedding, soap and 27 towels and medical and dental care. All institutions and 28 facilities of the Department shall require every committed 29 person to wear a standardized uniform prescribed by the chief 30 administrative officer of the institution or facility. 31 (e) All institutions and facilities of the Department -2- LRB9009812RCcd 1 shall permit every committed person to send and receive an 2 unlimited number of uncensored letters, provided, however, 3 that the Director may order that mail be inspected and read 4 for reasons of the security, safety or morale of the 5 institution or facility. 6 (f) All of the institutions and facilities of the 7 Department shall permit every committed person to receive 8 visitors, except in case of abuse of the visiting privilege 9 or when the chief administrative officer determines that such 10 visiting would be harmful or dangerous to the security, 11 safety or morale of the institution or facility. The chief 12 administrative officer shall have the right to restrict 13 visitation to non-contact visits for reasons of safety, 14 security, and order, including, but not limited to, 15 restricting contact visits for committed persons engaged in 16 gang activity. 17 (g) All institutions and facilities of the Department 18 shall permit religious ministrations and sacraments to be 19 available to every committed person, but attendance at 20 religious services shall not be required. 21 (h) Within 90 days after December 31, 1996, the 22 Department shall prohibit the use of curtains, 23 cell-coverings, or any other matter or object that obstructs 24 or otherwise impairs the line of vision into a committed 25 person's cell. 26 (i) All institutions and facilities of the Department 27 shall prohibit committed persons access to cable television 28 services as defined in Section 16-10 of the Criminal Code of 29 1961 and shall prohibit committed persons from using cellular 30 telephones in the institution or facility. 31 (Source: P.A. 89-609, eff. 1-1-97; 89-659, eff. 1-1-97; 32 89-688, eff. 6-1-97; 89-689, eff. 12-31-96; 90-14, eff. 33 7-1-97.)
