          Amends the  Civil  Administrative  Code  of  Illinois  by
      making  technical  changes  to  the  Section  concerning  the
      Department of Public Health's duties with respect to AIDS.

 1        AN ACT to amend the Civil Administrative Code of Illinois
 2    by changing Section 55.41.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Civil Administrative Code of Illinois  is
 6    amended by changing Section 55.41 as follows:
 7        (20 ILCS 2310/55.41) (from Ch. 127, par. 55.41)
 8        Sec.  55.41.  AIDS.  To perform the following in relation
 9    to the prevention and treatment of acquired  immunodeficiency
10    syndrome (AIDS):
11        (a)  Establish  a  State  AIDS  Control  Unit  within the
12    Department  as  a  separate  administrative  subdivision,  to
13    coordinate all State programs and services  relating  to  the
14    prevention, treatment, and amelioration of AIDS.
15        (b)  Conduct    a   public   information   campaign   for
16    physicians,  hospitals,  health  facilities,  public   health
17    departments,  law  enforcement  personnel,  public employees,
18    laboratories   and   the   general   public    on    acquired
19    immunodeficiency  syndrome  (AIDS)  and  to promote necessary
20    measures to reduce the incidence of AIDS  and  the  mortality
21    from AIDS. This program shall include, but not be limited to,
22    the  establishment  of  a  Statewide hotline and a State AIDS
23    information clearinghouse that will provide periodic  reports
24    and  releases  to  public  officials,  health  professionals,
25    community  service  organizations,  and  the  general  public
26    regarding   new   developments   or   procedures   concerning
27    prevention and treatment of AIDS.
28        (c)  Establish  an AIDS Advisory Council consisting of 25
29    persons appointed by the Governor,  including  representation
30    from   public   and   private   agencies,  organizations  and
31    facilities  involved  in  AIDS   research,   prevention   and

 1    treatment,  that  which  shall  advise  the Department on the
 2    State  AIDS  Control  Plan.   The  terms   of   the   initial
 3    appointments  shall  be  staggered  so  that  13  members are
 4    appointed for 2-year terms and 12 members are  appointed  for
 5    4-year terms. All subsequent appointments shall be for 4-year
 6    terms.   Members shall serve without compensation, but may be
 7    reimbursed for expenses incurred in relation to their  duties
 8    on the Council.  A Chairman, and any such other officers that
 9    as  may  be considered necessary, shall be elected from among
10    the members.  Any vacancy shall be filled for the term of the
11    original appointment.  Members whose terms have  expired  may
12    continue to serve until their successors are appointed.
13        (d)  Establish  alternative  blood test services that are
14    not operated by a blood bank, plasma center or hospital.  The
15    Department  shall  prescribe  by   rule   minimum   criteria,
16    standards  and procedures for the establishment and operation
17    of those such services, that which shall include, but not  be
18    limited  to  requirements  for  the provision of information,
19    counseling, and referral  services  that  ensure  appropriate
20    counseling and referral for persons whose blood is tested and
21    shows  evidence  of  exposure  to  the human immunodeficiency
22    virus (HIV) or other identified causative agent  of  acquired
23    immunodeficiency syndrome (AIDS).
24        (e)  Establish regional and community service networks of
25    public   and   private   service  providers  or  health  care
26    professionals  who  may  be  involved   in   AIDS   research,
27    prevention and treatment.
28        (f)  Provide  grants  to  individuals,  organizations  or
29    facilities to support the following:
30        (1)  information, referral and treatment services;
31        (2)  interdisciplinary    workshops   for   professionals
32    involved in research and treatment;
33        (3)  establishment and operation of a Statewide hotline;
34        (4)  establishment and operation of  alternative  testing

 1    services;
 2        (5)  research into detection, prevention and treatment;
 3        (6)  supplementation   of   other   public   and  private
 4    resources;
 5        (7)  implementation  by  long-term  care  facilities   of
 6    Department   standards   and  procedures  for  the  care  and
 7    treatment of  persons  with  AIDS,  and  the  development  of
 8    adequate numbers and types of placements for such persons.
 9        (g)  Conduct  a  study and report to the Governor and the
10    General Assembly by July 1, 1988, on the public  and  private
11    costs  of  AIDS medical treatment, including the availability
12    and accessibility of inpatient,  outpatient,  physician,  and
13    community support services.
14        (h)  Accept  any  gift,  donation,  bequest,  or grant of
15    funds from private  or  public  agencies,  including  federal
16    funds that may be provided for AIDS control efforts.
17        (i)  Develop  and  implement,  in  consultation  with the
18    Long-Term  Care  Facility  Advisory  Board,   standards   and
19    procedures  for  long-term  care facilities that provide care
20    and treatment of persons  with  AIDS,  including  appropriate
21    infection  control  procedures.  The  Department  shall  work
22    cooperatively  with  organizations  representing  those  such
23    facilities   to   develop   adequate  numbers  and  types  of
24    placements for persons  with  AIDS,  and  shall  advise  such
25    facilities  on  proper  implementation  of  its standards and
26    procedures.
27        (j)  The  Department  shall  create  and   administer   a
28    training  program  for  State  employees  who have a need for
29    understanding matters relating to AIDS in order to deal  with
30    or  advise  the  public.   The  Such  training  shall include
31    information on the cause and effects of AIDS,  the  means  of
32    detecting   it   and   preventing   its   transmission,   the
33    availability of related counseling and referral, and any such
34    other  matters that as may be appropriate.  The Such training

 1    may also be made available to employees of local governments,
 2    public service agencies and private agencies  which  contract
 3    with  the  State;  in  such cases the Department may charge a
 4    reasonable fee to recover the cost of the training.
 5        (k)  Approve  tests  or  testing   procedures   used   in
 6    determining exposure to HIV or any other identified causative
 7    agent of AIDS.
