          Amends   the   Illinois   Municipal   Code.    Allows   a
      municipality  to  adopt  reasonable  rules  and   regulations
      governing  the  examination  of, licensing of, regulation of,
      and  fees  for  persons  installing  or  altering  electrical
      equipment.

 1        AN ACT to amend the Illinois Municipal Code  by  changing
 2    Sections 11-33-1 and 11-37-3.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Municipal  Code  is  amended  by
 6    changing Sections 11-33-1 and 11-37-3 as follows:
 7        (65 ILCS 5/11-33-1) (from Ch. 24, par. 11-33-1)
 8        Sec.  11-33-1.  Electrical  contractors.   The  corporate
 9    authorities of each municipality may require the registration
10    of   electrical   contractors,   and  may  impose  an  annual
11    registration fee of $25 on  each  registered  contractor.  An
12    electrical  contractor who is registered in one municipality,
13    however, shall not be required by any other  municipality  to
14    be  registered  or  to  pay  a  registration fee in the other
15    municipality.
16        The  term  "electrical  contractor,"  as  used  in   this
17    Section,   means  any  person  engaged  in  the  business  of
18    installing or altering by contract electrical  equipment  for
19    the utilization of electricity for light, heat, or power. But
20    the  term  "electrical  contractor"  shall  not  include  the
21    installing  or  altering  of (1) radio apparatus or equipment
22    for  wireless  reception  of  sounds  and  signals,  or   (2)
23    apparatus, conductors, or other equipment installed for or by
24    public  utilities,  including common carriers, that which are
25    under the jurisdiction of the Illinois  Commerce  Commission,
26    for use in their operation as public utilities. Nor shall the
27    term   include   the  employees  employed  by  an  electrical
28    contractor to do or supervise his work.
29        Nothing in this  Section  shall  prohibit  the  corporate
30    authorities of a municipality from implementing the rules and
31    regulations authorized under Section 11-37-3 of this Code.

 3        Sec.  11-37-3.  The electrical commission shall recommend
 4    (1) safe and practical standards and specifications  for  the
 5    installation,  alteration,  and  use  of electrical equipment
 6    designed to  meet  the  necessities  and  conditions  of  the
 7    particular  locality,  (2)  reasonable  rules and regulations
 8    governing  the  issuance  of  permits   by   the   electrical
 9    inspection department, and (3) reasonable fees to be paid for
10    the inspection by the inspection department of all electrical
11    equipment  installed  or altered within the municipality, and
12    (4)  reasonable   rules   and   regulations   governing   the
13    examination  of,  licensing  of,  regulation of, and fees for
14    persons installing  or  altering  electrical  equipment.  The
15    standards,  specifications,  rules,  regulations, and fees so
16    recommended shall  not  become  effective  until  adopted  by
17    ordinance  by  the corporate authorities of the municipality.
18    All  fees  so  adopted  shall  be  paid  into  the  municipal
19    treasury.
20        In  a  municipality  that  which   has   established   an
21    electrical  inspection  department,  no  electrical equipment
22    shall be installed or altered  except  upon  a  permit  first
23    issued   by   that   department.  The  electrical  inspection
24    department shall  issue  permits  for  the  installation  and
25    alteration   of  electrical  equipment  in  all  cases  where
26    application  is  made  in  accordance  with  the  rules   and
27    regulations applicable thereto. That department shall inspect
28    all   electrical   equipment  installed  or  altered  in  the
29    municipality  and  shall  require  that  it  conform  to  the
30    standards  and  specifications  applicable  and  adopted   as
31    provided in this section.
