LRB9010943LDbdA LRB9010943LDbdA 1 AN ACT to amend the Illinois Pesticide Act by adding 2 Section 31. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pesticide Act is amended by 6 adding Section 31 as follows: 7 (415 ILCS 60/31 new) 8 Sec. 31. Reports. 9 (a) Any person licensed under this Act as a commercial 10 pesticide applicator, a commercial not-for-hire applicator, 11 or a private applicator shall report annually the types and 12 amounts of pesticides and herbicides he or she applied to 13 cropland in the previous year to the Department of 14 Agriculture on forms provided by the Department. 15 (b) The Department shall compile these reports into a 16 database that is publicly accessible in a written report, on 17 the internet, or both. At a minimum, the database shall 18 state the volume of all pesticides and herbicides used (i) by 19 type or active ingredient and (ii) by county and watershed. 20 The first report shall be published as soon as possible after 21 January 1, 1999 and subsequent reports shall be published 22 annually thereafter. The first report shall include the 20 23 most commonly used pesticides and herbicides. In each 24 subsequent year the report shall be expanded by the next 20 25 most commonly used pesticides and herbicides until all 26 commercially applied pesticide and herbicide formulations are 27 included. 28 (c) The Department of Agriculture shall publicize the 29 availability of the reports by means of press releases, 30 public service announcements, and other means.
