          Amends the Soil and  Water  Conservation  Districts  Act.
      Removes  the requirement that the non-bare-root plant stock a
      soil and water conservation district  may  sell  must  be  in
      one-gallon or smaller pots.

 1        AN ACT to amend the Soil and Water Conservation Districts
 2    Act by changing Section 22.05.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Soil and Water Conservation Districts Act
 6    is amended by changing Section 22.05 as follows:
 7        (70 ILCS 405/22.05) (from Ch. 5, par. 127.5)
 8        Sec. 22.05. To make available, on such terms as it  shall
 9    prescribe,  to  landowners  or occupiers within the district,
10    the  use  of  agricultural  and  engineering  machinery   and
11    equipment,  and  such  other  material  or  equipment as will
12    assist such landowners or occupiers to  carry  on  operations
13    upon  their  lands  for  the  conservation  of soil and water
14    resources and for the prevention and control of soil  erosion
15    and erosion floodwater and sediment damages.
16        Soil  and  water conservation districts may engage in the
17    direct sale of trees, shrubs, or  other  plant  materials  as
18    provided  in  this Section.  Plant materials that may be sold
19    are seeds of annual or perennial plants, bare-root stock,  or
20    other  stock  in  pots  not  to exceed one gallon.  The plant
21    material shall be advertised as follows:
22             "These plants are for conservation purposes only and
23        shall not be used as ornamentals or for landscaping."
24        For purposes of  this  Section,  "stock"  means  hardwood
25    trees  not  to  exceed  48  inches, conifers not to exceed 36
26    inches, shrubs not to exceed 24 inches, or  any  other  plant
27    materials not to exceed 24 inches.
