1 AMENDMENT TO HOUSE BILL 3165
2 AMENDMENT NO. . Amend House Bill 3165 on page 4, by
3 inserting below line 29 the following:
4 "Section 7. The University of Illinois Act is amended by
5 adding Section 7h as follows:
6 (110 ILCS 305/7h new)
7 Sec. 7h. Livestock management facilities; report.
8 (a) Legislative findings. The General Assembly finds
9 that (i) hog production in Illinois has decreased from 7.9
10 million head to 4.7 million head between 1982 and 1996; (ii)
11 there has been an increase in the number of large scale hog
12 production facilities across the United States; (iii) large
13 scale hog production facilities in Illinois may be
14 contaminating the navigable waterways and aquifers in
15 Illinois; (iv) large scale hog production facilities may have
16 had an impact on small family hog farms in Illinois; and (v)
17 large scale hog production facilities may have had an impact
18 on the Illinois grain market.
19 (b) Report. The Board of Trustees at the University of
20 Illinois shall direct the College of Agricultural, Consumer
21 and Environmental Sciences to prepare a report on the
22 following:

1 (1) the effect of large scale hog production
2 facilities in Illinois on the navigable waterways and
3 aquifers in Illinois; data for this portion of the report
4 shall come from the Water Survey Research Center at the
5 University of Illinois;
6 (2) the effect of large scale hog production
7 facilities in the United States on the small family hog
8 farmer in Illinois; and
9 (3) the effect of large scale hog production
10 facilities in the United States on grain production,
11 grain prices, grain farmers in Illinois, and other
12 matters related to the Illinois grain market.
13 In preparing the report, the College of Agricultural,
14 Consumer and Environmental Sciences at the University of
15 Illinois shall use, but shall not be limited to using, data
16 from a recent study prepared by the Federal Reserve Bank of
17 Chicago. The report shall provide a list of conclusions and
18 list recommendations to the General Assembly regarding the
19 increase in large scale hog production facilities and the
20 effect of those facilities on navigable waterways and
21 aquifers in Illinois; on small family hog farmers in
22 Illinois; and on grain production, grain prices, and grain
23 farmers in Illinois.
24 The report shall be completed no later than January 15,
25 1999."; and
26 on page 4, line 31, by replacing "Section 65" with "Sections
27 12 and 65"; and
28 on page 4, by inserting above line 32 the following:
29 "(510 ILCS 77/12 new)
30 Sec. 12. Moratorium.
31 (a) Notwithstanding any other provision of this Act or
32 any other provision of law, if any new facility as defined in

1 Section 10.45 of 500 or more animal units has not commenced
2 operations before the effective date of this amendatory Act,
3 then during calendar year 1998 no construction may be
4 commenced or continued and no operations may be commenced
5 with respect to that facility.
6 (b) Notwithstanding any other provision of this Act or
7 any other provision of law, if any new facility as defined in
8 Section 10.45 (regardless of whether it is classified as a
9 "new facility" before or after expansion) has commenced
10 operations before the effective date of this amendatory Act,
11 then during calendar year 1998 no expansion of that facility
12 may be commenced or continued and no operations may be
13 commenced with respect to the expansion of that facility if
14 either before or after the expansion it is or will be a new
15 facility of 500 or more animal units.".
