Makes technical changes. LRB9007952SMpk LRB9007952SMpk 1 AN ACT regarding burial. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Funeral or Burial Funds Act is 5 amended by changing Section 3b as follows: 6 (225 ILCS 45/3b) (from Ch. 111 1/2, par. 73.103b) 7 Sec. 3b. The Comptroller, at his or her expense, shall 8 provide a certified shorthand reporter to take down the 9 testimony and preserve a record of all proceedings at the 10 hearing of any case involving the refusal to issue or renew a 11 license, the suspension or revocation of a license, the 12 imposition of a monetary penalty, or the referral of a case 13 for criminal prosecution. The record of any such proceeding 14 shall consist of the notice of hearing, complaint, all other 15 documents in the nature of pleadings and written motions 16 filed in the proceedings, the transcript of testimony and the 17 report and orders of the Comptroller. Copies of the 18 transcript of thesuchrecord may be purchased from the 19 certified shorthand reporter who prepared the record. 20 (Source: P.A. 84-839.) 21 Section 10. The Cemetery Care Act is amended by changing 22 Section 6 as follows: 23 (760 ILCS 100/6) (from Ch. 21, par. 64.6) 24 Sec. 6. The trust funds authorized by Section 3 of this 25 Act, and the income from those trust fundstherefrom, and any 26 funds received under a contract to furnish care of a burial 27 space for a definite number of years, shall be held for the 28 general benefit of the lot owners and are exempt from 29 taxation. The trust funds authorized by the provisions of -2- LRB9007952SMpk 1 Section 3 of this Act, and the income from those trust funds 2therefrom, are exempt from the operation of all laws of 3 mortmain and the laws against perpetuities and accumulations. 4 (Source: Laws 1967, p. 1188.) 5 Section 15. The Illinois Pre-Need Cemetery Sales Act is 6 amended by changing Section 2 as follows: 7 (815 ILCS 390/2) (from Ch. 21, par. 202) 8 Sec. 2. This Act applies to all persons, except 9 religious, municipal, State and federal cemeteries, that 10 offer for sale or sell cemetery merchandise, cemetery 11 services, or undeveloped interment, entombment or inurnment 12 spaces on a pre-need basis. 13 Nothing in this Act appliesshall be deemed to applyto 14 pre-arranged funeral programs covered under the Illinois 15 Funeral or Burial Funds Act. 16 (Source: P.A. 88-477.)
