Amends the Consumer Fraud and Deceptive Business
Practices Act. Provides that it is a violation of the Act to
solicit the authority to execute a change of
telecommunications carrier or to provide any
telecommunications service or enhanced telecommunications
service through or in connection with any sweepstakes,
contest, or similar promotional program.

1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2E.2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2E.2 as follows:
7 (815 ILCS 505/2E.2 new)
8 Sec. 2E.2. Use of sweepstakes or prize promotion;
9 telecommunications services.
10 (a) For the purposes of this Section, (i)
11 "telecommunications carrier" means the same as in Section
12 13-202 of the Public Utilities Act; (ii) "telecommunications
13 service" means the same as in Section 13-203 of the Public
14 Utilities Act; and (iii) "enhanced telecommunications
15 service" means any service or merchandise, other than
16 interLATA, intraLATA, or local exchange service, for which
17 any charge or assessment appears on the billing statement of
18 a telecommunications carrier that is directed to a consumer.
19 (b) It is a violation of this Act for any person to
20 solicit the authority to execute a change of
21 telecommunications carrier or to provide any
22 telecommunications service or enhanced telecommunications
23 service through or in connection with any sweepstakes,
24 contest, or similar promotional program.
