Provides that an Internet service provider must cancel the account of a customer in this State if the customer has not used the services of the Internet service provider for a continuous period of 90 days, unless the customer has affirmatively communicated to the Internet service provider by electronic mail, telephone, or U.S. Postal Service mail that the customer wishes the account to remain open. Provides that an Internet service provider must not charge the customer for service after the date an account is canceled in accordance with these requirements. Provides that an Internet service provider who violates any of these provisions commits an unlawful practice within the meaning of the Act. The Consumer Fraud and Deceptive Business 6 Practices Act is amended by adding Section 2JJ as follows: 7 (815 ILCS 505/2JJ new) 8 Sec. 2JJ. Internet service providers. An Internet 9 service provider must cancel the account of a customer in 10 this State if the customer has not used the services of the 11 Internet service provider for a continuous period of 90 12 days, unless the customer has affirmatively communicated to 13 the Internet service provider by electronic mail, telephone, 14 or U.S. Postal Service mail that the customer wishes the 15 account to remain open. An Internet service provider must 16 not charge the customer for service after the date an account 17 is canceled in accordance with this Section. An Internet 18 service provider who violates any provision of this Section 19 commits an unlawful practice within the meaning of this Act. 20 As used in this Section, "Internet service provider" 21 means a person (regardless of whether the person is located 22 within or outside of Illinois) who provides access 23 (regardless of whether the access is through an online 24 service that provides other services that are not part of the 25 Internet) to customers in this State on an ongoing basis to 26 Internet electronic mail, the World Wide Web, Internet file 27 transfers, or any other information or data that may be sent 28 or received through the Internet.
