Provides that at least 80% of a prisoner's compensation from a correctional industry employment program shall be used to offset the cost of the prisoner's incarceration. The Unified Code of Corrections is amended by 6 changing Section 3-12-5 as follows: 7 (730 ILCS 5/3-12-5) (from Ch. 38, par. 1003-12-5) 8 Sec. 3-12-5. Compensation. Persons performing a work 9 assignment under subsection (a) of Section 3-12-2 may receive 10 wages under rules and regulations of the Department. In 11 determining rates of compensation, the Department shall 12 consider the effort, skill and economic value of the work 13 performed. Compensation may be given to persons who 14 participate in other programs of the Department. Of the 15 compensation earned pursuant to this Section, at least 80%a16portion, as determined by the Department, shall be used to 17 offset the cost of the committed person's incarceration. If 18 the committed person files a lawsuit determined frivolous 19 under Article XXII of the Code of Civil Procedure, 50% of the 20 compensation shall be used to offset the filing fees and 21 costs of the lawsuit as provided in that Article until all 22 fees and costs are paid in full. All other wages shall be 23 deposited in the individual's account under rules and 24 regulations of the Department. The Department shall notify 25 the Attorney General of any compensation applied towards a 26 satisfaction, in whole or in part, of the person's 27 incarceration costs. 28 (Source: P.A. 90-505, eff. 8-19-97.)
