Provides that an individual otherwise eligible for unemployment insurance benefits shall not be disqualified from receiving those benefits for being a member of the Illinois National Guard or of a United States Armed Forces reserve component. The Unemployment Insurance Act is amended by 6 changing Section 406 as follows: 7 (820 ILCS 405/406) (from Ch. 48, par. 406) 8 Sec. 406. Benefits after termination of military service; 9 guardspersons and reservists. 10 An individual otherwise eligible for benefits shall not 11 be disqualified from the receipt thereof by reason of one of 12 the following: 13 (1) Being entitled to readjustment allowances under 14 the Servicemen's Readjustment Act of 1944; provided, 15 however, that the filing of a valid claim in any benefit 16 year for readjustment allowance under said Act by a 17 claimant for any week shall, when followed by 18 authorization of payment thereof, be deemed an election 19 by such claimant to avail himself of his rights to 20 readjustment allowances under such Servicemen's 21 Readjustment Act throughout the benefit year in which 22 such week occurs in preference to those under this Act, 23 and shall disqualify such claimant for benefits until 24 whichever of the following events first occurs: 25 (A) the exhaustion of all his rights to 26 readjustment allowances under the Servicemen's 27 Readjustment Act of 1944; or 28 (B) the end of such benefit year. 29 (2) Being a member of the Illinois National Guard 30 or of a United States Armed Forces reserve component. 31 (Source: Laws 1951, p. 32.)
