LRB9010058LDdv LRB9010058LDdv 1 AN ACT to amend the Environmental Protection Act by 2 changing Section 9.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Environmental Protection Act is amended 6 by changing Section 9.2 as follows: 7 (415 ILCS 5/9.2) (from Ch. 111 1/2, par. 1009.2) 8 Sec. 9.2. (a) The Agency shall review all Illinois 9 sulfur dioxide emission standards for existing fuel 10 combustion stationary emission sources located within the 11 Chicago, St. Louis (Illinois), and Peoria major metropolitan 12 areas and, if appropriate following thatsuchreview, propose 13 amendments to thosesuchstandards to the Board by July 1, 14 1980, or within 90 days of receipt of the initial reports 15 required pursuant to Section 6.1 of this Act, whichever is 16 later. The standards proposed by the Agency shall be 17 designed to enhance the use of Illinois coal, consistent with 18 the need to attain and maintain the National Ambient Air 19 Quality Standards for sulfur dioxide and particulate matter. 20 (b) In granting any alternative emission standard or 21 variance relating to sulfur dioxide emissions from a 22 coal-burning stationary source, the Board may require the use 23 of Illinois coal as a condition of such alternative standard 24 or variance, provided that the Board determines that Illinois 25 coal of the proper quality is available and competitive in 26 price; such determination shall include consideration of the 27 cost of pollution control equipment and the economic impact 28 on the Illinois coal mining industry. 29 (Source: P.A. 84-585.)
