      105 ILCS 5/Act rep.
          Repeals the School Code effective July 1, 2001.  Provides
      for the immediate creation of a 15 member School Code  Review
      Committee to review and evaluate all provisions of the School
      Code  and  requires  it to report to the Governor and General
      Assembly, on or before the second  Wednesday  of  January  of
      2000  and 2001, with its recommendations for legislation that
      will  more  effectively  attain  the  State's  objective   of
      establishing  an  efficient  system  of  high  quality public
      educational institutions and services at the  elementary  and
      secondary  levels.   Provides  for  the  chairperson  of  the
      Committee to be appointed by the Governor with the advice and
      consent  of  the  Senate,  for 4 members to be appointed (one
      each) by the legislatives leaders, and for 10 members  to  be
      appointed  by  specified  business  and educational entities.
      Adds provisions relative to member terms  and  Committee  and
      member   expenses,  and  provides  for  the  State  Board  of
      Education to provide such staff assistance as  the  Committee
      may  reasonably  request.   Provides  that  the  Committee is
      dissolved upon the filing of its  final  report  in  January,
      2001.  Effective immediately, except the repeal of the School
      Code takes effect July 1, 2001.

 1        AN ACT concerning education.
 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:
 4                              ARTICLE 1
 5        (105 ILCS 5/Act rep.)
 6        Section 1-1.  The School Code is repealed.
 7                              ARTICLE 5
 8        Section 5-1.  Short title.  This Article may be cited  as
 9    the School Review Committee Law.
10        Section  5-5.  Creation  of  Committee; terms; vacancies;
11    expenses.  There is hereby created  the  School  Code  Review
12    Committee to consist of 15 members appointed as follows:  one
13    member appointed by the Governor, with the advice and consent
14    of  the  Senate,  who  shall  serve  as  Chairperson  of  the
15    Committee;  4 legislative members, one to be appointed by the
16    President of the Senate, one by the Minority  Leader  of  the
17    Senate,  one  by the Speaker of the House of Representatives,
18    and  one  by  the   Minority   Leader   of   the   House   of
19    Representatives;   one   member  appointed  by  each  of  the
20    following  entities:   the  Illinois  Association  of  School
21    Boards, the Illinois  Principals  Association,  the  Illinois
22    Association   of  School  Administrators,  and  the  Illinois
23    Association of School Business Officials;  4  representatives
24    of  the  business  community,  one  to  be  appointed  by the
25    Illinois  Manufacturers  Association,  one  by  the  Illinois
26    Chamber of Commerce, one by  the  Illinois  Retail  Merchants
27    Association,   and   one   by   the  National  Federation  of
28    Independent Businesses; one teacher-educator member appointed

 1    by the joint action of the Illinois  Federation  of  Teachers
 2    and the Illinois Education Association; and one parent member
 3    appointed by the Illinois Parent Teacher Association.
 4        Members  shall  serve  from the date of their appointment
 5    until the  School  Code  Review  Committee  is  dissolved  as
 6    provided  in  Section 5-15.  A vacancy on the Committee shall
 7    be  filled  by  appointment  in  the  same  manner   as   the
 8    appointment of the member that created the vacancy was made.
 9        Members  shall  serve  without  compensation but shall be
10    reimbursed  for  their  reasonable  and  necessary   expenses
11    incurred  in the performance of their duties.  Those expenses
12    and the expenses necessarily incurred by the Committee in the
13    exercise of  its  responsibilities  shall  be  reimbursed  or
14    provided  by the State Board of Education from appropriations
15    made to the State Board of Education for that purpose.
16        Section 5-10.  Organization of Committee; meetings.  Once
17    a majority of the members of the School Code Review Committee
18    (including the member appointed by the Governor to  serve  as
19    Chairperson  of  the  Committee, whether that appointment has
20    been confirmed by the Senate or has been made as a  temporary
21    appointment as in the case of vacancies) have been appointed,
22    the  Committee, at the call of the Chairperson, shall proceed
23    to organize itself, fix the date of its regular meetings, and
24    enter upon the discharge of its duties.  The regular meetings
25    of the Committee shall be held at least quarterly,  and  such
26    special  meetings  as  may  be necessary shall be held at the
27    call of the Chairperson or a majority of the members  of  the
28    Committee.
29        Section  5-15.  Responsibilities;  reports;  dissolution.
30    The  purpose and function of the School Code Review Committee
31    shall be to review and evaluate all provisions of the  School
32    Code  to  determine  whether  those provisions are consistent

 1    with the  State's  objective  of  establishing  an  efficient
 2    system  of  high  quality public educational institutions and
 3    services at the elementary and secondary school levels and to
 4    recommend any  replacement  legislation  that  the  Committee
 5    believes will be more effective in attaining that objective.
 6        The  State  Board  of  Education  shall  provide  to  the
 7    Committee   such   staff  and  assistance  as  the  Committee
 8    reasonably requests in order  to  exercise  and  perform  its
 9    responsibilities under this Section.
10        The   Committee   shall   file  its  initial  report  and
11    recommendations with the Governor and the General Assembly on
12    or before the second  Wednesday  of  January  of  2000.   The
13    Committee shall consider any comments or response made by the
14    Governor  or  General  Assembly  to the initial report of the
15    Committee and shall file a final report  and  recommendations
16    for  any  necessary  legislation  with  the  Governor and the
17    General Assembly on or before the second Wednesday of January
18    of 2001.  Upon the filing of that final report, the Committee
19    shall be deemed dissolved by operation of law.
20        Section 99.  Effective date.  This Act takes effect  upon
21    becoming  law, except that Article 1 of this Act takes effect
22    July 1, 2001.
