Amends the Counties Code. Provides that in addition to
their salaries, sheriffs shall receive an annual stipend of
$6,500 for their additional duties imposed by other statutes
or laws. Deletes the provisions concerning an annual stipend
for sheriffs who operate a county jail. Effective December
1, 1998.

1 AN ACT to amend the Counties Code by changing Sections
2 3-10007, 4-6001, 4-6003, and 4-8002.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Counties Code is amended by changing
6 Sections 3-10007, 4-6001, 4-6003, and 4-8002 as follows:

8 Sec. 3-10007. Annual stipend. In addition to all other
9 compensation provided by law, every elected county treasurer,
10 for additional duties mandated by State law, shall receive an
11 annual stipend of (i) $5,000 if his or her term begins before
12 December 1, 1998, (ii) $5,500 after December 1, 1998 and
13 $6,500 after December 1, 1999 if his or her term begins on or
14 after December 1, 1998 but before December 1, 2000, and (iii)
15 $6,500 if his or her term begins December 1, 2000 or
16 thereafter, to be annually appropriated from the General
17 Revenue Fund by the General Assembly to the Department of
18 Revenue which shall distribute the awards in annual lump sum
19 payments to every elected county treasurer. This annual
20 stipend shall not affect any other compensation provided by
21 law to be paid to elected county treasurers. No county board
22 may reduce or otherwise impair the compensation payable from
23 county funds to an elected county treasurer if such reduction
24 or impairment is the result of his receiving an annual
25 stipend under this Section.

28 Sec. 4-6001. Officers in counties of less than 2,000,000.
29 (a) In all counties of less than 2,000,000 inhabitants, the
30 compensation of Coroners, County Treasurers, County Clerks,

1 Recorders and Auditors shall be determined under this
2 Section. The County Board in those counties shall fix the
3 amount of the necessary clerk hire, stationery, fuel and
4 other expenses of those officers. The compensation of those
5 officers shall be separate from the necessary clerk hire,
6 stationery, fuel and other expenses, and such compensation
7 (except for coroners in those counties with less than
8 2,000,000 population in which the coroner's compensation is
9 set in accordance with Section 4-6002) shall be fixed within
10 the following limits:
11 To each such officer in counties containing less than
12 14,000 inhabitants, not less than $13,500 per annum.
13 To each such officer in counties containing 14,000 or
14 more inhabitants, but less than 30,000 inhabitants, not less
15 than $14,500 per annum.
16 To each such officer in counties containing 30,000 or
17 more inhabitants but less than 60,000 inhabitants, not less
18 than $15,000 per annum.
19 To each such officer in counties containing 60,000 or
20 more inhabitants but less than 100,000 inhabitants, not less
21 than $15,000 per annum.
22 To each such officer in counties containing 100,000 or
23 more inhabitants but less than 200,000 inhabitants, not less
24 than $16,500 per annum.
25 To each such officer in counties containing 200,000 or
26 more inhabitants but less than 300,000 inhabitants, not less
27 than $18,000 per annum.
28 To each such officer in counties containing 300,000 or
29 more inhabitants but less than 2,000,000 inhabitants, not
30 less than $20,000 per annum.
31 (b) Those officers beginning a term of office before
32 December 1, 1990 shall be compensated at the rate of their
33 base salary. "Base salary" is the compensation paid for each
34 of those offices, respectively, before July 1, 1989.

1 (c) Those officers beginning a term of office on or
2 after December 1, 1990 shall be compensated as follows:
3 (1) Beginning December 1, 1990, base salary plus at
4 least 3% of base salary.
5 (2) Beginning December 1, 1991, base salary plus at
6 least 6% of base salary.
7 (3) Beginning December 1, 1992, base salary plus at
8 least 9% of base salary.
9 (4) Beginning December 1, 1993, base salary plus at
10 least 12% of base salary.
11 (d) In addition to but separate and apart from the
12 compensation provided in this Section, the county clerk of
13 each county, the recorder of each county, that does not have
14 a county board of election commissioners and the chief clerk
15 of each county board of election commissioners shall receive
16 an award of $3,500 per annum for the additional duties
17 required of such officer by the consolidation of elections
18 law. as follows:
19 (1) $4,500 per year after January 1, 1998;
20 (2) $5,500 per year after January 1, 1999; and
21 (3) $6,500 per year after January 1, 2000.
22 The total amount required for such awards each year shall be
23 appropriated by the General Assembly to the State Board of
24 Elections which shall distribute the awards in annual lump
25 sum payments to the several county clerks, recorders, and
26 chief election clerks. Beginning December 1, 1990, this
27 annual award, and any other award or stipend paid out of
28 State funds to county officers, shall not affect any other
29 compensation provided by law to be paid to county officers.
30 (e) Beginning December 1, 1990, no county board may
31 reduce or otherwise impair the compensation payable from
32 county funds to a county officer if the reduction or
33 impairment is the result of the county officer receiving an
34 award or stipend payable from State funds.

1 (f) The compensation, necessary clerk hire, stationery,
2 fuel and other expenses of the county auditor, as fixed by
3 the county board, shall be paid by the county.
4 (g) The population of all counties for the purpose of
5 fixing compensation, as herein provided, shall be based upon
6 the last Federal census immediately previous to the election
7 of the officer in question in each county.

10 Sec. 4-6003. Compensation of sheriffs for certain
11 expenses in counties of less than 2,000,000.
12 (a) The County Board, in all counties of less than
13 2,000,000 inhabitants, shall fix the compensation of
14 sheriffs, with the amount of their necessary clerk hire,
15 stationery, fuel and other expenses. The county shall supply
16 the sheriff with all necessary uniforms, guns and ammunition.
17 The compensation of each such officer shall be fixed
18 separately from his necessary clerk hire, stationery, fuel
19 and other expenses, and such compensation shall be fixed
20 within the following limits:
21 To each such sheriff in counties containing less than
22 10,000 inhabitants, not less than $27,000 per annum.
23 To each such sheriff in counties containing 10,000 or
24 more inhabitants but less than 20,000 inhabitants, not less
25 than $31,000 per annum.
26 To each such sheriff in counties containing 20,000 or
27 more inhabitants but less than 30,000 inhabitants, not less
28 than $34,000 per annum.
29 To each such sheriff in counties containing 30,000 or
30 more inhabitants but less than 60,000 inhabitants, not less
31 than $37,000 per annum.
32 To each such sheriff in counties containing 60,000 or
33 more inhabitants but less than 100,000 inhabitants, not less

1 than $40,000 per annum.
2 To each such sheriff in counties containing 100,000 or
3 more inhabitants but less than 2,000,000 inhabitants, not
4 less than $43,000 per annum.
5 The population of each county for the purpose of fixing
6 compensation as herein provided, shall be based upon the last
7 Federal census immediately previous to the election of the
8 sheriff in question in such county.
9 (b) Those sheriffs beginning a term of office before
10 December 1, 1990 shall be compensated at the rate of their
11 base salary. "Base salary" is the compensation paid for each
12 of those offices, respectively, before July 1, 1989.
13 (c) Those sheriffs beginning a term of office on or
14 after December 1, 1990 shall be compensated as follows:
15 (1) Beginning December 1, 1990, base salary plus at
16 least 3% of base salary.
17 (2) Beginning December 1, 1991, base salary plus at
18 least 6% of base salary.
19 (3) Beginning December 1, 1992, base salary plus at
20 least 9% of base salary.
21 (4) Beginning December 1, 1993, base salary plus at
22 least 12% of base salary.
23 (d) In addition to the salary provided for in
24 subsections (a), (b), and (c), beginning December 1, 1998
25 1990, each sheriff who operates a county jail for their
26 additional duties imposed by other statutes or laws shall
27 receive an the following annual stipend to be paid by the
28 State in the amount of $6,500:
29 $2,000; plus:
30 $1,000 if the county jail has more than 100 beds but
31 fewer than 200; or
32 $2,000 if the county jail has 200 or more beds but
33 fewer than 300; or
34 $3,000 if the county jail has 300 or more beds.

1 (e) No county board may reduce or otherwise impair the
2 compensation payable from county funds to a sheriff if the
3 reduction or impairment is the result of the sheriff
4 receiving an award or stipend payable from State funds.

7 Sec. 4-8002. Compensation of sheriff for jail operation.
8 In addition to any salary otherwise provided by law,
9 beginning December 1, 1998, the sheriff of Cook County for
10 his or her additional duties imposed by other statutes or
11 laws shall receive an annual stipend of $5,000, to be paid by
12 the State in the amount of $6,500, based on the sheriff's
13 operation of county jail facilities having a total of more
14 than 300 beds. The county board shall not reduce or
15 otherwise impair the compensation payable from county funds
16 to the sheriff if the reduction or impairment is the result
17 of the sheriff receiving a stipend payable from State funds.

19 Section 99. Effective date. This Act takes effect on
