90_HB3703 405 ILCS 30/4 from Ch. 91 1/2, par. 904 Amends the Community Services Act. Provides that the annual appropriation to the Department of Human Services to fund community services for the developmentally disabled and mentally ill shall include a percentage increase for the wages of direct care workers that is equivalent to the Employment Cost Index for Health Service Occupations, which increase shall be in addition to any increase attributable to other factors, including cost of doing business increases for community services. Provides that the increases in wages that are based on the Employment Cost Index for direct care workers in community settings shall be applied to appropriations to the Department beginning July 1, 1998 for the State fiscal year 1999 and ending June 30, 2001 for the State fiscal year 2001. Provides that the Department shall receive certification from the provider agency that any increase appropriated pursuant to this amendatory Act of 1998 shall be utilized in its entirety to provide wage increases to direct care workers. LRB9010521SMdv LRB9010521SMdv 1 AN ACT in relation to public services. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Community Services Act is amended by 5 changing Section 4 as follows: 6 (405 ILCS 30/4) (from Ch. 91 1/2, par. 904) 7 Sec. 4. Financing for Community Services. The Department 8 of Human Services is authorized to provide financial 9 assistance to eligible private service providers, 10 corporations, local government entities or voluntary 11 associations for the provision of services to persons with 12 mental illness, persons with a developmental disability and 13 alcohol and drug dependent persons living in the community 14 for the purpose of achieving the goals of this Act. 15 The Department shall utilize the following funding 16 mechanisms for community services: 17 (1) Purchase of Care Contracts: services purchased 18 on a predetermined fee per unit of service basis from 19 private providers or governmental entities. Fee per 20 service rates are set by an established formula which 21 covers some portion of personnel, supplies, and other 22 allowable costs, and which makes some allowance for 23 geographic variations in costs as well as for additional 24 program components. 25 (2) Grants: sums of money which the Department 26 grants to private providers or governmental entities 27 pursuant to the grant recipient's agreement to provide 28 certain services, as defined by departmental grant 29 guidelines, to an approximate number of service 30 recipients. Grant levels are set through consideration of 31 personnel, supply and other allowable costs, as well as -2- LRB9010521SMdv 1 other funds available to the program. 2 (3) Other Funding Arrangements: funding mechanisms 3 may be established on a pilot basis in order to examine 4 the feasibility of alternative financing arrangements for 5 the provision of community services. 6 The annual appropriation to the Department of Human 7 Services (formerly the Department of Mental Health and 8 Developmental Disabilities) to fund community services for 9 the developmentally disabled and mentally ill shall include a 10 percentage increase for the wages of direct care workers that 11 is equivalent to the Employment Cost Index for Health Service 12 Occupations. The increases for direct care workers shall be 13 in addition to any increases that are attributable to other 14 factors, including general cost of doing business increases 15 for community services. The increases in wages that are 16 based on the Employment Cost Index for direct care workers in 17 community settings shall be applied to appropriations to the 18 Department beginning July 1, 1998 for the State fiscal year 19 1999 and ending June 30, 2001, for the State fiscal year 20 2001. 21 The Department shall receive certification from the 22 provider agency that any increase appropriated pursuant to 23 this amendatory Act of 1998 shall be utilized in its entirety 24 to provide wage increases to direct care workers. The 25 Department shall monitor the effects of these increases on 26 turnover of direct care staff and quality of care for persons 27 served and shall report the results to the Governor, Speaker 28 of the House of Representative, President of the Senate, and 29 the minority leaders of both Houses by January 1, 2002. 30 The Department shall strive to establish and maintain an 31 equitable system of payment which encourages providers to 32 improve their clients' capabilities for independence and 33 reduces their reliance on community or State-operated 34 services. In accepting Department funds, providers shall -3- LRB9010521SMdv 1 recognize their responsibility to be accountable to the 2 Department and the State for the delivery of services which 3 are consistent with the philosophies and goals of this Act 4 and the rules and regulations promulgated under it. 5 (Source: P.A. 88-380; 89-507, eff. 7-1-97.) 6 Section 99.
