          Amends the Counties Code.   Provides  that  each  sheriff
      shall  receive an annual stipend of (i) $5,500 after December
      1, 1998 and $6,500 after December 1, 1999 if his or her  term
      begins  on  or  after December 1, 1998 but before December 1,
      2000 or (ii) $6,500 if his or her term begins on December  1,
      2000  or  thereafter (now stipend amount depends on number of
      beds in  the  jail  the  sheriff  operates).   Increases  the
      stipend of a county treasurer from $5,000 to (i) $5,500 after
      December  1, 1998 and $6,500 after December 1, 1999 if his or
      her term begins on or  after  December  1,  1998  but  before
      December  1, 2000 or (ii) $6,500 if his or her term begins on
      December 1, 2000 or  thereafter.  Increases  the  stipend  of
      certain  county  clerks  from  $3,500  to  (i)  $5,500  after
      December  1,  1998 and $6,500 after December 1, 1999 if their
      term begins on or after December 1, 1998 but before  December
      1,  2000  or  (ii) $6,500 if their term begins on December 1,
      2000 or thereafter.  Effective immediately.

 1        AN ACT to amend the Counties Code  by  changing  Sections
 2    3-10007, 4-6001, 4-6003, and 8-1002.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Counties  Code  is  amended  by  changing
 6    Sections 3-10007, 4-6001, 4-6003, and 8-1002 as follows:

 8        Sec.  3-10007.   Annual stipend. In addition to all other
 9    compensation provided by law, every elected county treasurer,
10    for additional duties mandated by State law, shall receive an
11    annual stipend of (i) $5,000 if his or her term begins before
12    December 1, 1998, (ii) $5,500  after  December  1,  1998  and
13    $6,500 after December 1, 1999 if his or her term begins on or
14    after December 1, 1998 but before December 1, 2000, and (iii)
15    $6,500  if  his  or  her  term  begins  December  1,  2000 or
16    thereafter, to be  annually  appropriated  from  the  General
17    Revenue  Fund  by  the  General Assembly to the Department of
18    Revenue which shall distribute the awards in annual lump  sum
19    payments  to  every  elected  county  treasurer.  This annual
20    stipend shall not affect any other compensation  provided  by
21    law to be paid to elected county treasurers.  No county board
22    may  reduce or otherwise impair the compensation payable from
23    county funds to an elected county treasurer if such reduction
24    or impairment is  the  result  of  his  receiving  an  annual
25    stipend under this Section.

28        Sec. 4-6001. Officers in counties of less than 2,000,000.
29    (a)  In  all counties of less than 2,000,000 inhabitants, the
30    compensation of Coroners, County Treasurers,  County  Clerks,

 1    Recorders   and  Auditors  shall  be  determined  under  this
 2    Section.  The County Board in those counties  shall  fix  the
 3    amount  of  the  necessary  clerk  hire, stationery, fuel and
 4    other expenses of those officers.  The compensation of  those
 5    officers  shall  be  separate  from the necessary clerk hire,
 6    stationery, fuel and other expenses,  and  such  compensation
 7    (except  for  coroners  in  those  counties  with  less  than
 8    2,000,000  population  in which the coroner's compensation is
 9    set in accordance with Section 4-6002) shall be fixed  within
10    the following limits:
11        To  each  such  officer  in counties containing less than
12    14,000 inhabitants, not less than $13,500 per annum.
13        To each such officer in  counties  containing  14,000  or
14    more  inhabitants, but less than 30,000 inhabitants, not less
15    than $14,500 per annum.
16        To each such officer in  counties  containing  30,000  or
17    more  inhabitants  but less than 60,000 inhabitants, not less
18    than $15,000 per annum.
19        To each such officer in  counties  containing  60,000  or
20    more  inhabitants but less than 100,000 inhabitants, not less
21    than $15,000 per annum.
22        To each such officer in counties  containing  100,000  or
23    more  inhabitants but less than 200,000 inhabitants, not less
24    than $16,500 per annum.
25        To each such officer in counties  containing  200,000  or
26    more  inhabitants but less than 300,000 inhabitants, not less
27    than $18,000 per annum.
28        To each such officer in counties  containing  300,000  or
29    more  inhabitants  but  less  than 2,000,000 inhabitants, not
30    less than $20,000 per annum.
31        (b)  Those officers beginning a  term  of  office  before
32    December  1,  1990  shall be compensated at the rate of their
33    base salary.  "Base salary" is the compensation paid for each
34    of those offices, respectively, before July 1, 1989.

 1        (c)  Those officers beginning a  term  of  office  on  or
 2    after December 1, 1990 shall be compensated as follows:
 3        (1)  Beginning  December  1,  1990,  base  salary plus at
 4    least 3% of base salary.
 5        (2)  Beginning December 1,  1991,  base  salary  plus  at
 6    least 6% of base salary.
 7        (3)  Beginning  December  1,  1992,  base  salary plus at
 8    least 9% of base salary.
 9        (4)  Beginning December 1,  1993,  base  salary  plus  at
10    least 12% of base salary.
11        (d)  In  addition  to  but  separate  and  apart from the
12    compensation provided in this Section, the  county  clerk  of
13    each  county  that  does  not have a county board of election
14    commissioners and the chief clerk of  each  county  board  of
15    election  commissioners  shall receive an award of (i) $3,500
16    per annum if his or her term begins before December 1,  1998,
17    (ii)  $5,500 after December 1, 1998 and $6,500 after December
18    1, 1999 per annum if his or  her  term  begins  on  or  after
19    December  1,  1998  but  before  December  1, 2000, and (iii)
20    $6,500 per annum if his or her term begins December  1,  2000
21    or  thereafter  for  the  additional  duties required of such
22    officer by the consolidation of  elections  law.   The  total
23    amount   required   for   such  awards  each  year  shall  be
24    appropriated by the General Assembly to the  State  Board  of
25    Elections  which  shall  distribute the awards in annual lump
26    sum payments to the several county clerks and chief  election
27    clerks.  Beginning  December  1, 1990, this annual award, and
28    any other award or stipend paid out of State funds to  county
29    officers, shall not affect any other compensation provided by
30    law to be paid to county officers.
31        (e)  Beginning  December  1,  1990,  no  county board may
32    reduce or otherwise  impair  the  compensation  payable  from
33    county  funds  to  a  county  officer  if  the  reduction  or
34    impairment  is  the result of the county officer receiving an

 1    award or stipend payable from State funds.
 2        (f) The compensation, necessary clerk  hire,  stationery,
 3    fuel  and  other  expenses of the county auditor, as fixed by
 4    the county board, shall be paid by the county.
 5        (g) The population of all counties  for  the  purpose  of
 6    fixing  compensation, as herein provided, shall be based upon
 7    the last Federal census immediately previous to the  election
 8    of the officer in question in each county.

11        Sec.   4-6003.   Compensation  of  sheriffs  for  certain
12    expenses in counties of less than 2,000,000.
13        (a)  The County Board,  in  all  counties  of  less  than
14    2,000,000   inhabitants,   shall   fix  the  compensation  of
15    sheriffs, with the amount  of  their  necessary  clerk  hire,
16    stationery, fuel and other expenses.  The county shall supply
17    the sheriff with all necessary uniforms, guns and ammunition.
18    The   compensation  of  each  such  officer  shall  be  fixed
19    separately from his necessary clerk  hire,  stationery,  fuel
20    and  other  expenses,  and  such  compensation shall be fixed
21    within the following limits:
22        To each such sheriff in  counties  containing  less  than
23    10,000 inhabitants, not less than $27,000 per annum.
24        To  each  such  sheriff  in counties containing 10,000 or
25    more inhabitants but less than 20,000 inhabitants,  not  less
26    than $31,000 per annum.
27        To  each  such  sheriff  in counties containing 20,000 or
28    more inhabitants but less than 30,000 inhabitants,  not  less
29    than $34,000 per annum.
30        To  each  such  sheriff  in counties containing 30,000 or
31    more inhabitants but less than 60,000 inhabitants,  not  less
32    than $37,000 per annum.
33        To  each  such  sheriff  in counties containing 60,000 or

 1    more inhabitants but less than 100,000 inhabitants, not  less
 2    than $40,000 per annum.
 3        To  each  such  sheriff in counties containing 100,000 or
 4    more inhabitants but less  than  2,000,000  inhabitants,  not
 5    less than $43,000 per annum.
 6        The  population  of each county for the purpose of fixing
 7    compensation as herein provided, shall be based upon the last
 8    Federal census immediately previous to the  election  of  the
 9    sheriff in question in such county.
10        (b)  Those  sheriffs  beginning  a  term of office before
11    December 1, 1990 shall be compensated at the  rate  of  their
12    base salary.  "Base salary" is the compensation paid for each
13    of those offices, respectively, before July 1, 1989.
14        (c)  Those  sheriffs  beginning  a  term  of office on or
15    after December 1, 1990 shall be compensated as follows:
16             (1)  Beginning December 1, 1990, base salary plus at
17        least 3% of base salary.
18             (2)  Beginning December 1, 1991, base salary plus at
19        least 6% of base salary.
20             (3)  Beginning December 1, 1992, base salary plus at
21        least 9% of base salary.
22             (4)  Beginning December 1, 1993, base salary plus at
23        least 12% of base salary.
24        (d)  In  addition  to  the   salary   provided   for   in
25    subsections (a), (b), and (c), beginning December 1, 1990 and
26    for  sheriffs whose term begins before December 1, 1998, each
27    sheriff  who  operates  a  county  jail  shall  receive   the
28    following annual stipend to be paid by the State:
29             $2,000; plus:
30             $1,000 if the county jail has more than 100 beds but
31        fewer than 200; or
32             $2,000  if  the county jail has 200 or more beds but
33        fewer than 300; or
34             $3,000 if the county jail has 300 or more beds.

 1        (d-5)  In  addition  to  the  salary  provided   for   in
 2    subsections  (a),  (b),  and (c), each sheriff who operates a
 3    county jail shall receive an annual stipend to be paid by the
 4    State of (i) $5,500 after December 1, 1998 and  $6,500  after
 5    December  1,  1999  if  his  or  her  term begins on or after
 6    December 1, 1998 but before December 1, 2000 and (ii)  $6,500
 7    if his or her term begins December 1, 2000 or thereafter.
 8        (e)  No  county  board may reduce or otherwise impair the
 9    compensation payable from county funds to a  sheriff  if  the
10    reduction   or  impairment  is  the  result  of  the  sheriff
11    receiving an award or stipend payable from State funds.

14        Sec. 4-8002.  Compensation of sheriff for jail operation.
15    In addition to any salary  otherwise  provided  by  law,  the
16    sheriff  of Cook County shall receive an annual stipend to be
17    paid by the State of (i) $5,000, to be  paid  by  the  State,
18    based  on  the  sheriff's operation of county jail facilities
19    having a total of more than 300 beds if  the  sheriff's  term
20    begins before December 1, 1998, (ii) $5,500 after December 1,
21    1998  and $6,500 after December 1, 1999 if the sheriff's term
22    begins on or after December 1, 1998 but  before  December  1,
23    2000, or (ii) $6,500 if the sheriff's term begins on December
24    1,  2000 or thereafter.  The county board shall not reduce or
25    otherwise impair the compensation payable from  county  funds
26    to  the  sheriff if the reduction or impairment is the result
27    of the sheriff receiving a stipend payable from State funds.

29        Section 99.  Effective date.  This Act takes effect  upon
30    becoming law.
