90_HB3712 New Act Creates the Electrical Contractor Act. Provides for the registration of a person who practices as an electrical contractor. Provides that electrical contractors shall be supervised by a supervising electrician who meets certain qualifications. LRB9010452LDdv LRB9010452LDdv 1 AN ACT to create the Electrical Contractor Act. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Electrical Contractor Act. 6 Section 5. Definitions. As used in this Act: 7 "Department" means the Department of Professional 8 Regulation. 9 "Director" means the Director of Professional Regulation. 10 "Electrical contractor" means a person or firm that 11 installs, alters, repairs, or maintains electrical wires, 12 equipment, and apparatus. 13 "Electrical contracting" means the installation, 14 alteration, repair, or maintenance of electrical wires, 15 equipment, and apparatus. 16 "Supervising electrician" means a person who has met the 17 qualifications under Section 40 and is registered as a 18 supervising electrician. 19 Section 10. Registration required. Beginning January 1, 20 2000, it shall be unlawful for any person to engage in the 21 business of electrical contracting without being registered 22 as an electrical contractor as provided in this Act. 23 Section 15. Application and registration of electrical 24 contractor. Any person, firm, or corporation desiring to 25 engage in the business of electrical contracting shall apply 26 for registration with the Department. Upon the filing of an 27 application in proper form and the payment of the 28 registration fee as provided in Section 25, the Director 29 shall register the applicant as an electrical contractor and -2- LRB9010452LDdv 1 shall issue to the applicant a certificate of registration. 2 A valid certificate of registration shall authorize the 3 person to whom it is issued to engage in the business of 4 electrical contracting if he or she has designated a 5 supervising electrician as provided in Section 30. 6 Section 20. Certificate of registration as electrical 7 contractor. A certificate of registration as an electrical 8 contractor shall be valid for 2 years from the date of 9 issuance. A certificate of registration shall not be 10 transferable and shall contain the name of the certificate 11 holder's supervising electrician. 12 Section 25. Registration and renewal fee. The fee for a 13 certificate of registration as an electrical contractor shall 14 be $100 for each year the registration is valid, which sum 15 shall be paid by the applicant to the Department in advance 16 upon filing the application. The fee for renewal of a 17 registration shall be $100 for each year the registration is 18 valid. If there is any change in the information required in 19 an application for registration including, but not limited 20 to, a change in company name, ownership registration, or 21 supervising electrician, the registrant shall re-register 22 with the Department and pay a re-registration fee of $100. 23 Section 30. Appointment of supervising electrician. No 24 person may be certified as an electrical contractor unless he 25 or she employs or appoints a supervising electrician who 26 meets the qualifications provided under Section 40. An 27 electrical contractor may appoint himself or herself as the 28 supervising electrician if he or she meets the qualifications 29 under Section 40. 30 Section 35. Application for certificate of registration -3- LRB9010452LDdv 1 as supervising electrician. An applicant for registration as 2 a supervising electrician shall file an application with the 3 Department in writing on a form furnished by the Department. 4 Section 40. Qualifications for registration as 5 supervising electrician. 6 (a) An applicant for registration as a supervising 7 electrician shall be at least 21 years of age and have at 8 least 2 years experience in the installation, alteration, 9 repair, and maintenance of electrical wires, equipment, and 10 apparatus, or the equivalent. An applicant for registration 11 as a supervising electrician shall furnish the names and 12 addresses of former employers, periods of time employed by 13 each, and the capacity in which he or she was employed by 14 each former employer. This information and all other required 15 information shall be provided upon forms available from the 16 Department. A person must pass an examination under 17 subsection (b) to practice as a supervising electrician. 18 (b) The Department shall prepare and hold examinations 19 for applicants for registration as a supervising electrician 20 at least once every 3 months. These examinations shall be 21 sufficiently strict to indicate whether an applicant has 22 satisfactory knowledge and technical training to perform or 23 to supervise the installation, alteration, repair, or 24 maintenance of electrical wires and apparatus. It shall be 25 the responsibility of the Department to exercise control and 26 supervision of the examinations. 27 (c) Each applicant shall pay an examination fee of $100 28 for each examination he or she takes. The applicant shall pay 29 the fee to the Department before the day on which he or she 30 takes the examination. 31 (d) If the applicant does not pass the examination, he 32 or she shall be required to wait 6 months before 33 reapplication. -4- LRB9010452LDdv 1 Section 45. Certification as supervising electrician. 2 If an applicant complies with the requirements of Section 40 3 and pays the appropriate fee, the Department shall certify 4 him or her as a supervising electrician to a registered 5 electrical contractor by placing his or her name on both the 6 registration certificate and identification card issued to 7 the registered electrical contractor. No person shall be 8 designated as the supervising electrician for more than one 9 electrical contracting business at one time. The fee for 10 registration as a supervising electrician is $100 for each 11 year the registration is valid. Each registration shall be 12 valid for a period of 2 years from the date of issuance. 13 Section 50. Duties of supervising electrician. A 14 supervising electrician shall perform or supervise and direct 15 the installation, alteration, repair, and maintenance of 16 electrical wires and apparatus authorized by a valid permit 17 for the conduct of electrical contracting. An application for 18 a permit to conduct electrical contracting shall be 19 countersigned by the supervising electrician. 20 Section 55. Notice of discharge or resignation. 21 Whenever a supervising electrician leaves or is discharged 22 from the employ of an electrical contractor, both the 23 employer and the supervising electrician shall provide 24 written notice thereof to the Department within 5 days. Upon 25 the discharge or resignation of a supervising electrician, an 26 electrical contractor may not practice electrical contracting 27 until the employment or appointment by the electrical 28 contractor of a supervising electrician pursuant to Section 29 30. A supervising electrician may transfer a valid 30 registration to another electrical contractor with the 31 permission of the Department, which permission shall not be 32 unreasonably withheld. The fee for such a transfer shall be -5- LRB9010452LDdv 1 $50. 2 Section 60. Reexamination. If a supervising electrician 3 has not acted in the capacity of a supervising electrician 4 for a continuous period of 3 years, he or she must retake an 5 examination pursuant to Section 40 before he or she may be 6 certified as a supervising electrician. 7 Section 65. Bond of electrical contractor. No person 8 may practice as an electrical contractor unless he or she 9 posts a bond with the Department sufficient to cover 10 liability of up to $1,000,000.
