      720 ILCS 5/24-8
          Amends the Criminal Code  of  1961.   Provides  that  the
      local  law  enforcement  agency  shall use the best available
      information, including a firearms trace, to determine how and
      from whom a person who is not permitted by federal  or  State
      law  to possess a firearm gained possession of a firearm (now
      the provision applies only when the  law  enforcement  agency
      recovers the firearm from a person under 21 years of age).

 1        AN  ACT  to  amend  the Criminal Code of 1961 by changing
 2    Section 24-8.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Criminal  Code  of  1961 is amended by
 6    changing Section 24-8 as follows:
 7        (720 ILCS 5/24-8)
 8        Sec. 24-8.  Firearm tracing.
 9        (a)  Upon recovering a firearm  from  the  possession  of
10    anyone  under 21 years of age who is not permitted by federal
11    or State law to possess a firearm, a  local  law  enforcement
12    agency  shall use the best available information, including a
13    firearms trace when where necessary,  to  determine  how  and
14    from  whom  where  the  person  under  21 years of age gained
15    possession of the firearm.
16        (b)  Local law enforcement shall, when  appropriate,  use
17    the National Tracing Center of the Federal Bureau of Alcohol,
18    Tobacco and Firearms in complying with subsection (a) of this
19    Section.
20        (c)  Local   law   enforcement  agencies  shall  use  the
21    Illinois Department of State Police Law Enforcement  Agencies
22    Data  System (LEADS) Gun File to enter all stolen, seized, or
23    recovered firearms as prescribed  by  LEADS  regulations  and
24    policies.
