90_HB3899 105 ILCS 230/5-35 Amends the School Construction Law. Provides that for fiscal years subsequent to fiscal year 1999, the total amount of school construction project grants awarded statewide shall be allocated among 4 regions in proportion to the aggregate average daily attendance of the school districts in each such region. Establishes the 4 regions as (1) the City of Chicago; (2) suburban Cook County; (3) the counties of Dupage, Kane, Kendall, Lake, McHenry, and Will; and (4) the remainder of the State. Provides for the award of the aggregate grant funds allocated to a region to eligible school districts within that region in accordance with the priority order determined for school construction projects that are based upon the approved district facilities plans of those school districts. LRB9013174THpk LRB9013174THpk 1 AN ACT to amend the School Construction Law by changing 2 Section 5-35. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The School Construction Law is amended by 6 changing Section 5-35 as follows: 7 (105 ILCS 230/5-35) 8 Sec. 5-35. School construction project grant amounts; 9 prohibited use. 10 (a) The product of the district's grant index and the 11 recognized project cost, as determined by the Capital 12 Development Board, for an approved school construction 13 project shall equal the amount of the grant the Capital 14 Development Board shall provide to the eligible district. 15 The grant index shall not be used in cases where the General 16 Assembly and the Governor approve appropriations designated 17 for specifically identified school district construction 18 projects. 19 (b) Of theIn each fiscal year in whichschool 20 construction project grants that are awarded in fiscal year 21 1999, 20% of the total amount awarded statewide shall be 22 awarded to a school district with a population exceeding 23 500,000, provided such district complies with the provisions 24 of this Article. In each fiscal year after fiscal year 1999 25 in which school construction project grants are awarded, the 26 total amount awarded statewide shall be allocated among 4 27 regions, in proportion to the aggregate average daily 28 attendance of all school districts in each such region as 29 that average daily attendance is determined and used by the 30 State Board of Education to compute the general State aid of 31 school districts under Section 18-8.05 of the School Code for -2- LRB9013174THpk 1 the fiscal year in which the school construction project 2 grants are awarded. The 4 regions among which the total 3 amount of school construction project grants awarded in a 4 fiscal year subsequent to fiscal year 1999 is to be so 5 allocated are: (1) the territory falling within the 6 corporate boundaries of the City of Chicago; (2) the 7 territory falling within the corporate boundaries of Cook 8 County, exclusive of the territory falling within the 9 corporate boundaries of the City of Chicago; (3) the 10 territory falling within the corporate boundaries of the 11 counties of DuPage, Kane, Kendall, Lake, McHenry, and Will; 12 and (4) the territory falling within the corporate boundaries 13 of all counties of the State, exclusive of the territory 14 falling with the corporate boundaries of the counties of 15 Cook, DuPage, Kane, Kendall, Lake, McHenry, and Will. The 16 aggregate amount of school construction project grants 17 allocated to a region in a fiscal year subsequent to fiscal 18 year 1999 shall be awarded to school districts within that 19 region that meet applicable eligibility and project standards 20 and otherwise comply with the provisions of this Article, in 21 accordance with the priority order determined by the State 22 Board of Education under this Article for school construction 23 projects that are based upon the approved district facilities 24 plans of those school districts. 25 (c) No portion of a school construction project grant 26 awarded by the Capital Development Board shall be used by a 27 school district for any on-going operational costs. 28 (Source: P.A. 90-548, eff. 1-1-98.) 29 Section 99.
