90_HC0009 ILCON Art. X, Sec. 1 ILCON Art. X, Sec. 1.5 new Proposes to amend the Education Article of the Illinois Constitution. In the Section relating to the goal of free schools, deletes language which provides that the State has primary responsibility for financing the system of public education. Adds a new Section relating to funding and accountability for elementary and secondary education. Requires the General Assembly to provide criteria and incentives for an efficient, high quality system of elementary and secondary public education, including funding, educational achievement, and accountability. Requires the General Assembly to establish and review, at least every 2 years, the per pupil level of financial support, to provide for a combination of State and local funds to meet foundation level of support requirements, and to substantially reduce in the aggregate taxes levied by school districts upon real property. Provides that in the aggregate at least half of the funding necessary for the foundation level must be provided by the State from State resources and prohibits more than half of the funding for the foundation level in the aggregate from being provided from taxes levied on real property. Requires the General Assembly to provide by law for supplemental funding, above the foundation level, from State, local, and other resources. Requires implementation of the amendment's provisions by the General Assembly on or before May 30, 1999. Effective upon approval by the electors. LRB9004264THgc LRB9004264THgc 1 HOUSE JOINT RESOLUTION 2 CONSTITUTIONAL AMENDMENT 3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 4 NINETIETH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 5 SENATE CONCURRING HEREIN, that there shall be submitted to 6 the electors of the State for adoption or rejection at the 7 general election next occurring at least 6 months after the 8 adoption of this resolution a proposition to amend Section 1 9 of and add Section 1.5 to Article X of the Illinois 10 Constitution as follows: 11 ARTICLE X 12 EDUCATION 13 (ILCON Art. X, Sec. 1) 14 SECTION 1. GOAL - FREE SCHOOLS 15 A fundamental goal of the People of the State is the 16 educational development of all persons to the limits of their 17 capacities. 18 The State shall provide for an efficient system of high 19 quality public educational institutions and services. 20 Education in public schools through the secondary level shall 21 be free. There may be such other free education as the 22 General Assembly provides by law. 23The State has the primary responsibility for financing24the system of public education.25 (Source: Illinois Constitution.) 26 (ILCON Art. X, Sec. 1.5 new) 27 SECTION 1.5. FUNDING AND ACCOUNTABILITY 28 (a) The General Assembly shall provide by law the 29 criteria and incentives for an efficient, high quality system 30 of elementary and secondary public education, including 31 funding, educational achievement, and accountability. -2- LRB9004264THgc 1 (b) The General Assembly shall establish and review at 2 least every two years the per pupil foundation level of 3 financial support that provides and maintains an efficient, 4 high quality system. The General Assembly shall provide by 5 law for a combination of State and local funds to meet the 6 requirements of the foundation level of support. In the 7 aggregate, at least half of such funding necessary for the 8 foundation level shall be provided by the State from State 9 resources. No more than half of such funding for the 10 foundation level in the aggregate shall be provided from 11 taxes levied upon real property. 12 (c) Concurrent with implementation of the system of 13 funding required by this Section, the State shall 14 substantially reduce in the aggregate the taxes levied by 15 school districts upon real property. 16 (d) The General Assembly shall provide by law for 17 supplemental funding above the foundation level from State, 18 local, and other resources and shall establish limitations, 19 including requirements for local referenda, on the provision 20 of supplemental funding from local taxes. 21 (e) On or before May 30, 1999, the General Assembly 22 shall provide by law for implementation of this Amendment. 23 SCHEDULE 24 This Constitutional Amendment takes effect upon approval 25 by the electors of this State.
