In a municipality with more than 500,000 inhabitants, creates a Citizens Review Board to monitor housing authority police, with 3 members appointed by the Governor, 2 members appointed by the presiding officer of the municipality, and one member appointed by each of the legislative leaders of the General Assembly. Authorizes the Board to suspend, terminate, or take other disciplinary action against an officer who verbally or physically abused a tenant or tenant's guest or invitee while on or off duty or who entered the residence of a tenant unlawfully. LRB9000869SMcw LRB9000869SMcw 1 AN ACT to amend the Housing Authorities Act by adding 2 Section 8.1c. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Housing Authorities Act is amended by 6 adding Section 8.1c as follows: 7 (310 ILCS 10/8.1c new) 8 Sec. 8.1c. Citizens Review Board. A Citizens Review 9 Board is established for the housing authority in any 10 municipality having over 500,000 inhabitants to monitor the 11 housing authority police force. 12 The Board shall consist of 9 members with 3 appointed by 13 the Governor, 2 appointed by the presiding officer of the 14 municipality, and one appointed by each of the legislative 15 leaders of the General Assembly. The initial terms of the 16 members shall be one, 2, and 3 years for the members 17 appointed by the Governor and one and 2 years for the members 18 appointed by the presiding officer. Of the members appointed 19 by the legislative leaders of the General Assembly, one shall 20 serve for an initial term of one year, one shall serve for an 21 initial term of 2 years, and 2 shall serve for an initial 22 term of 3 years; the terms of each of those 4 members shall 23 be determined by lot. Each successor of the initial members 24 shall serve for a term of 4 years. The initial appointments 25 to the Board shall be made within 30 days of the effective 26 date of this amendatory Act of 1997. The Board shall select 27 one of its members to serve as chairperson. The Board may, 28 after notice and a hearing, remove by majority vote a member 29 of the Board who has been found guilty of neglect of duty or 30 malfeasance. If a member of the Board resigns or is removed, 31 the official who would appoint the member's successor shall -2- LRB9000869SMcw 1 appoint a person to serve the remainder of the member's term. 2 After a member's term expires, the member shall continue to 3 serve until a successor is appointed and qualified. 4 The Board has the authority, after holding a hearing, to 5 suspend, terminate, or take other disciplinary action against 6 a housing authority police officer if: 7 (1) the officer is found to have verbally or 8 physically abused a tenant or his or her guest or invitee 9 while the officer was on or off duty; or 10 (2) the officer is found to have entered the 11 residence of a housing authority tenant and was neither 12 (i) executing a legally issued arrest warrant or search 13 warrant for that residence nor (ii) otherwise lawfully 14 present in the residence. 15 Section 99. Effective date. This Act takes effect upon 16 becoming law.
