Amends the Unemployment Insurance Act to provide that the
term "employment" does not include certain services performed
for a photographer or photography studio when certain
conditions are met. Effective immediately.

1 AN ACT to amend the Unemployment Insurance Act by adding
2 Section 233.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Unemployment Insurance Act is amended by
6 adding Section 233.5 as follows:
7 (820 ILCS 405/233.5 new)
8 Sec. 233.5. Services for photographer.
9 (a) The term "employment" does not include those
10 services performed for or on behalf of a photographer or
11 photography studio by an individual as a photographer, make
12 up artist, stylist of food, clothing, or hair, model,
13 location scout, programmer, developer of photographic images,
14 set designer, or stylist or as an assistant to any of these
15 individuals when:
16 (1) services are performed in connection with
17 making still, digital, or celluloid photographs;
18 (2) the individual has the right to perform similar
19 services for others on whatever basis and whenever he or
20 she chooses;
21 (3) the individual performs services under a
22 business name; and
23 (4) the individual reports remuneration received
24 for services as an independent business or profession on
25 a federal income tax schedule.
26 (b) Subsection (a) does not apply to services required
27 to be covered as a condition of approval of this Act by the
28 United States Secretary of Labor under Section 3304(a)(6)(A)
29 of the Federal Unemployment Tax Act.
30 Section 99. Effective date. This Act takes effect upon
