          Amends  the  Illinois  Income  Tax  Act  to  create   tax
      checkoffs  for  the  Mental  Health  Research  Fund  and  the
      Children's  Cancer  Fund.   Amends  the  State Finance Act to
      create the Mental Health Research  Fund  and  the  Children's
      Cancer  Fund.    Amends  the  Civil  Administrative  Code  of
      Illinois  to  direct the Department of Human Services to make
      grants to organizations in Illinois for  research  of  mental
      illness and cancer in children.

 1        AN ACT concerning income tax checkoffs.
 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:
 4        Section 5. The Civil Administrative Code of  Illinois  is
 5    amended by adding Sections 55.85 and 55.86 as follows:
 6        (20 ILCS 2310/55.85 new)
 7        Sec. 55.85.  Grants from the Mental Health Research Fund.
 8    From funds appropriated from the Mental Health Research Fund,
 9    the  Department  of  Human  Services  shall  award  grants to
10    organizations in Illinois, for the  purpose  of  research  of
11    mental illness.

13        Sec.  55.86.  Children's  Cancer Fund; grants. From funds
14    appropriated from the Children's Cancer Fund, a special  fund
15    created  in  the  State  treasury,  the  Department  of Human
16    Services shall make grants to public or private  entities  in
17    Illinois,  including the Mitchell Ross Children's Cancer Fund
18    and the Cancer Wellness Center, for the purposes  of  funding
19    (i) research into causes, prevention, and treatment of cancer
20    in   children  and  (ii)  direct  community-based  supportive
21    services  and  programs  that  address   the   psychological,
22    emotional, and social needs of children with cancer and their
23    family members.
24        Section  10.   The State Finance Act is amended by adding
25    Sections 5.449 and 5.450 as follows:

 2        Sec. 5.450.  The Children's Cancer Fund.
 3        Section 15.  The Illinois Income Tax Act  is  amended  by
 4    changing  Sections  509  and 510 and adding Sections 507R and
 5    507S as follows:

 7        Sec. 507R.  Mental Health Research  Fund  checkoff.   The
 8    Department  shall print on its standard individual income tax
 9    form a provision indicating that if the  taxpayer  wishes  to
10    contribute  to the Mental Health Research Fund, as authorized
11    by this amendatory Act of 1997,  he  or  she  may  do  so  by
12    stating  the amount of the contribution (not less than $1) on
13    the  return  and  that  the  contribution  will  reduce   the
14    taxpayer's  refund  or  increase  the  amount  of  payment to
15    accompany  the  return.  Failure  to  remit  any  amount   of
16    increased  payment shall reduce the contribution accordingly.
17    This Section shall not apply to any amended return.

 1        Sec.  509.  Tax  checkoff  explanations.   All individual
 2    income   tax   return   forms   shall   contain   appropriate
 3    explanations and spaces to enable the taxpayers to  designate
 4    contributions  to  the  Child  Abuse  Prevention Fund, to the
 5    Community Health Center Care Fund, to the  Illinois  Wildlife
 6    Preservation  Fund  as  required  by  the  Illinois  Non-Game
 7    Wildlife  Protection Act, to the Alzheimer's Disease Research
 8    Fund as required by the Alzheimer's Disease Research Act,  to
 9    the  Assistance to the Homeless Fund as required by this Act,
10    to the Heritage Preservation Fund as required by the Heritage
11    Preservation Act, to the Child Care Expansion Program Fund as
12    required by the Child Care Expansion Program Act, to the Ryan
13    White  AIDS  Victims  Assistance  Fund,  to   the   Assistive
14    Technology   for  Persons  with  Disabilities  Fund,  to  the
15    Domestic Violence Shelter and Service  Fund,  to  the  United
16    States  Olympians  Assistance  Fund,  to the Youth Drug Abuse
17    Prevention Fund, to the Persian Gulf Conflict Veterans  Fund,
18    to the Literacy Advancement Fund, to the Ryan White Pediatric
19    and  Adult  AIDS  Fund,  to  the  Illinois  Special  Olympics
20    Checkoff  Fund,  to  the  Breast and Cervical Cancer Research
21    Fund, to the Korean War Memorial Fund, to the  Heart  Disease
22    Treatment  and  Prevention  Fund, to the Hemophilia Treatment
23    Fund, to the Mental Health Research Fund, to  the  Children's
24    Cancer  Fund, to the Women in Military Service Memorial Fund,
25    and to the Meals on Wheels Fund. Each form  shall  contain  a
26    statement  that  the contributions will reduce the taxpayer's
27    refund or increase the amount of  payment  to  accompany  the
28    return.   Failure  to  remit  any amount of increased payment
29    shall reduce the contribution accordingly.
30        If, on October 1 of any year, the total contributions  to
31    any  one  of  the  funds made under this Section do not equal
32    $100,000 or more, the explanations and spaces for designating
33    contributions  to  the  fund  shall  be  removed   from   the
34    individual  income tax return forms for the following and all

 1    subsequent years and all subsequent contributions to the fund
 2    shall be refunded to the taxpayer.

 7        Sec. 510.  Determination  of  amounts  contributed.   The
 8    Department  shall  determine  the total amount contributed to
 9    each of the following: the Child Abuse Prevention  Fund,  the
10    Illinois  Wildlife  Preservation  Fund,  the Community Health
11    Center Care Fund, the Assistance to the  Homeless  Fund,  the
12    Alzheimer's  Disease Research Fund, the Heritage Preservation
13    Fund, the Child Care Expansion Program Fund, the  Ryan  White
14    AIDS  Victims  Assistance  Fund, the Assistive Technology for
15    Persons with Disabilities Fund, the Domestic Violence Shelter
16    and Service Fund,  the  United  States  Olympians  Assistance
17    Fund,  the Youth Drug Abuse Prevention Fund, the Persian Gulf
18    Conflict Veterans Fund, the Literacy  Advancement  Fund,  the
19    Ryan  White  Pediatric  and  Adult  AIDS  Fund,  the Illinois
20    Special Olympics  Checkoff  Fund,  the  Breast  and  Cervical
21    Cancer Research Fund, the Korean War Memorial Fund, the Heart
22    Disease   Treatment   and  Prevention  Fund,  the  Hemophilia
23    Treatment  Fund,  the  Mental  Health  Research   Fund,   the
24    Children's   Cancer  Fund,  the  Women  in  Military  Service
25    Memorial Fund, and the Meals on Wheels Fund; and shall notify
26    the State Comptroller and the State Treasurer of the  amounts
27    to be transferred from the General Revenue Fund to each fund,
28    and upon receipt of such notification the State Treasurer and
29    Comptroller shall transfer the amounts.

 1        Section  99.  Effective date.  This Act takes effect upon
 2    becoming law.
