90_SB0108enr 225 ILCS 446/117 new Amends the Private Detective, Private Alarm, Private Security, and Locksmith Act of 1993 to require licensees to include their license number in any advertising relating to services regulated by the Act. Sets forth penalties for failure to display a license or to provide an accurate license number to a publisher when advertising. Effective immediately. LRB9000165DPcd SB108 Enrolled LRB9000165DPcd 1 AN ACT to amend the Private Detective, Private Alarm, 2 Private Security, and Locksmith Act of 1993 by adding Section 3 117. 4 Be it enacted by the People of the State of Illinois, 5 represented in the General Assembly: 6 Section 5. The Private Detective, Private Alarm, Private 7 Security, and Locksmith Act of 1993 is amended by adding 8 Section 117 as follows: 9 (225 ILCS 446/117 new) 10 Sec. 117. Advertisement; penalties. 11 (a) No licensee providing services regulated by this Act 12 may knowingly advertise those services without including his 13 or her license number in the advertisement. Nothing 14 contained in this Section requires the publisher of 15 advertising for such services to verify the accuracy of the 16 license number provided by the advertiser. 17 (b) A licensee who advertises services regulated by this 18 Act who knowingly (i) fails to display his or her license at 19 his or her place of business as required under Section 115, 20 (ii) fails to provide a publisher with the correct license 21 number, or (iii) provides a publisher with a false license 22 number or a license number of a person or agency other than 23 the person or agency doing the advertising, or a licensee who 24 knowingly allows his or her license number to be displayed or 25 used to allow another person or agency to circumvent any 26 provision of this Section, is guilty of a Class A 27 misdemeanor. Each day a licensee fails to display his or her 28 license as required under Section 115 and each day an 29 advertisement runs or a licensee allows his or her license to 30 be displayed or used in violation of this Section constitutes 31 a separate offense. In addition to the penalties and remedies SB108 Enrolled -2- LRB9000165DPcd 1 provided for in this Section, a licensee who violates any 2 provision of this Section shall be subject to the 3 disciplinary sanction and civil penalty provisions of this 4 Act. 5 Section 99. Effective date. This Act takes effect upon 6 becoming law.
