LRB9001515RCks LRB9001515RCks 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 changing Sections 111-1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by changing Section 111-1 as follows: 7 (725 ILCS 5/111-1) (from Ch. 38, par. 111-1) 8 Sec. 111-1. Methods of prosecution. 9 When authorized by law a prosecution may be commenced by: 10 (a) A complaint; 11 (b) An information; 12 (c) An indictment. 13 Upon commencement of a prosecution for a violation of 14 Section 11-501 of The Illinois Vehicle Code, or a similar 15 provision of a local ordinance, or Section 9-3 of the 16 Criminal Code of 1961, as amended,relating to the offense of 17 reckless homicide, the victims of these offenses shall have 18 all the rights under this Section as they do in Section 4 of 19 the Bill of Rights for Victims and Witnesses of Violent Crime 20 Act. 21 For the purposes of this Section "victim" shall mean an 22 individual who has suffered personal injury as a result of 23 the commission of a violation of Section 11-501 of The 24 Illinois Vehicle Code, or a similar provision of a local 25 ordinance, or Section 9-3 of the Criminal Code of 1961, as26amended,relating to the offense of reckless homicide. In 27 regard to a violation of Section 9-3 of the Criminal Code of 28 1961, as amended,relating to the offense of reckless 29 homicide, "victim" shall also include, but not be limited to, 30 spouse, guardian, parent, or other family member. 31 (Source: P.A. 84-272.)
