LRB9001048JSgc LRB9001048JSgc 1 AN ACT to amend the Public Utilities Act by changing 2 Section 13-402. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Utilities Act is amended by 6 changing Section 13-402 as follows: 7 (220 ILCS 5/13-402) (from Ch. 111 2/3, par. 13-402) 8 (This Section is scheduled to be repealed July 1, 1999.) 9 Sec. 13-402. Rules; waiver or modification. The 10 Commission is authorized, in connection with the issuance or 11 modification of a Certificate of Interexchange Service 12 Authority or the modification of a certificate of public 13 convenience and necessity for interexchange 14 telecommunications service, to waive or modify the 15 application of its rules, general orders, procedures, or 16 notice requirements when such action will reduce the economic 17 burdens of regulation and thesuchwaiver or modification is 18 not inconsistent with the law or the purposes and policies of 19 this Article. 20 Anysuchwaiver or modification granted to any 21 interexchange telecommunications carrier which has, or any 22 group of such carriers any one of which has annual revenues 23 exceeding $10,000,000 shall be automatically applied fully 24 and equally to all such carriers with annual revenues 25 exceeding $10,000,000 unless the Commission specifically 26 finds, after notice to all such carriers and a hearing, that 27 restricting the application of such waiver or modification to 28 only one such carrier or some group of such carriers is 29 consistent with and would promote the purposes and policies 30 of this Article and the protection of telecommunications 31 customers. -2- LRB9001048JSgc 1 (Source: P.A. 84-1063.) 2 Section 99.
