 1                    AMENDMENT TO SENATE BILL 155
 2        AMENDMENT NO.     .  Amend Senate Bill 155  by  replacing
 3    everything after the enacting clause with the following:
 4        "Section  5.  The  Counties  Code  is  amended  by adding
 5    Section 5-12009.5 as follows:
 6        (55 ILCS 5/5-12009.5 new)
 7        Sec. 5-12009.5. Special  use  authorization.  The  county
 8    board  may  provide  for  the classification of special uses.
 9    "Special uses" may include but are not limited to public  and
10    quasi-public  uses  affecting  the public interest, uses that
11    may have unique, special, or unusual impact upon the  use  or
12    enjoyment  of neighboring property, and planned developments.
13    A use may be a permitted use in one or more zoning  districts
14    and a special use in one more more other zoning districts.
15        A  special  use  may  be  permitted  only  after a public
16    hearing before the county zoning commission with prior notice
17    given as provided in Section  5-12009  of  this  Division.  A
18    special  use  shall  be permitted only upon evidence that the
19    use meets standards established for  the  classifications  in
20    the  ordinances, and the granting of permission therefore may
21    be subject to conditions reasonably  necessary  to  meet  the
22    standards.

 1        Those  municipalities  whose  boundaries are within 1 1/2
 2    miles of any part of the area proposed to be classified as  a
 3    special  use  shall be given notice of the hearing. The owner
 4    or owners of land immediately touching, or immediately across
 5    a street, alley, or public right-of-way from, at least 20% of
 6    the perimeter of the land to be affected by the  special  use
 7    shall  have  standing  to object to the granting of a special
 8    use permit. A majority vote of the county board  is  required
 9    to  grant  a  special  use  permit,  unless  the county board
10    provides by ordinance that a two-thirds vote is required.".
