Amend Senate Bill 186 by replacing 3 the title with the following: 4 "AN ACT to amend the Illinois Vehicle Code by adding 5 Section 1-154.4 and changing Sections 12-215 and 12-601."; 6 and 7 by replacing everything after the enacting clause with the 8 following: 9 "Section 5. The Illinois Vehicle Code is amended by 10 adding Section 1-154.4 and changing Sections 12-215 and 11 12-601 as follows: 12 (625 ILCS 5/1-154.4 new) 13 Sec. 1-154.4. Organ transport vehicle. A motor vehicle 14 of the second division equipped and used exclusively for the 15 transportation of organs for human transplant or the 16 transportation of members of the surgical team performing the 17 organ harvesting or transplant operations. Vehicles defined 18 in this Section shall be owned or operated by a company that 19 has a contractual agreement with a federally designated organ 20 procurement organization for the purposes stated in this 21 Section. -2- LRB9001951NTsbam 1 (625 ILCS 5/12-215) (from Ch. 95 1/2, par. 12-215) 2 (Text of Section before amendment by P.A. 89-507) 3 Sec. 12-215. Oscillating, rotating or flashing lights on 4 motor vehicles. Except as otherwise provided in this Code: 5 (a) The use of red or white oscillating, rotating or 6 flashing lights, whether lighted or unlighted, is prohibited 7 except on: 8 1. Law enforcement vehicles of State, Federal or 9 local authorities; 10 2. A vehicle operated by a police officer or county 11 coroner and designated or authorized by local 12 authorities, in writing, as a law enforcement vehicle; 13 however, such designation or authorization must be 14 carried in the vehicle; 15 3. Vehicles of local fire departments and State or 16 federal firefighting vehicles; 17 4. Vehicles which are designed and used exclusively 18 as ambulances or rescue vehicles; furthermore, such 19 lights shall not be lighted except when responding to an 20 emergency call for and while actually conveying the sick 21 or injured; and 22 5. Tow trucks licensed in a state that requires 23 such lights; furthermore, such lights shall not be 24 lighted on any such tow truck while the tow truck is 25 operating in the State of Illinois. 26 (b) The use of amber oscillating, rotating or flashing 27 lights, whether lighted or unlighted, is prohibited except 28 on: 29 1. Second division vehicles designed and used for 30 towing or hoisting vehicles; furthermore, such lights 31 shall not be lighted except as required in this paragraph 32 1; such lights shall be lighted when such vehicles are 33 actually being used at the scene of an accident or 34 disablement and while such vehicles are engaged in towing -3- LRB9001951NTsbam 1 on a highway; 2 2. Motor vehicles or equipment of the State of 3 Illinois, local authorities and contractors; furthermore, 4 such lights shall not be lighted except while such 5 vehicles are engaged in maintenance or construction 6 operations within the limits of construction projects; 7 3. Vehicles or equipment used by engineering or 8 survey crews; furthermore, such lights shall not be 9 lighted except while such vehicles are actually engaged 10 in work on a highway; 11 4. Vehicles of public utilities, municipalities, or 12 other construction, maintenance or automotive service 13 vehicles except that such lights shall be lighted only as 14 a means for indicating the presence of a vehicular 15 traffic hazard requiring unusual care in approaching, 16 overtaking or passing while such vehicles are engaged in 17 maintenance, service or construction on a highway; 18 5. Oversized vehicle or load; however, such lights 19 shall only be lighted when moving under permit issued by 20 the Department under Section 15-301 of this Code; 21 6. The front and rear of motorized equipment owned 22 and operated by the State of Illinois or any political 23 subdivision thereof, which is designed and used for 24 removal of snow and ice from highways; 25 7. Fleet safety vehicles registered in another 26 state, furthermore, such lights shall not be lighted 27 except as provided for in Section 12-212 of this Code; 28 8. Such other vehicles as may be authorized by 29 local authorities; 30 9. Law enforcement vehicles of State or local 31 authorities when used in combination with red 32 oscillating, rotating or flashing lights; 33 10. Vehicles used for collecting or delivering mail 34 for the United States Postal Service provided that such -4- LRB9001951NTsbam 1 lights shall not be lighted except when such vehicles are 2 actually being used for such purposes; 3 11. Any vehicle displaying a slow-moving vehicle 4 emblem as provided in Section 12-205.1; 5 12. All trucks equipped with self-compactors or 6 roll-off hoists and roll-on containers for garbage or 7 refuse hauling. Such lights shall not be lighted except 8 when such vehicles are actually being used for such 9 purposes; 10 13. Vehicles used by a security company, alarm 11 responder, or control agency, if the security company, 12 alarm responder, or control agency is bound by a contract 13 with a federal, State, or local government entity to use 14 the lights; and 15 14. Security vehicles of the Department of Mental 16 Health and Developmental Disabilities; however, the 17 lights shall not be lighted except when being used for 18 security related purposes under the direction of the 19 superintendent of the facility where the vehicle is 20 located. 21 (c) The use of blue oscillating, rotating or flashing 22 lights, whether lighted or unlighted is prohibited except: 23 1. On vehicles owned or fully operated by a: 24 voluntary firefighter; 25 paid firefighter; 26 part-paid firefighter; 27 call firefighter; 28 member of the board of trustees of a fire 29 protection district; 30 paid or unpaid member of a rescue squad; 31 paid or unpaid member of a voluntary ambulance 32 unit; 33 rescue squad vehicles not owned by a fire 34 department. -5- LRB9001951NTsbam 1 However, such lights are not to be lighted except 2 when responding to a bona fide emergency. 3 2. Police department vehicles in cities having a 4 population of 500,000 or more inhabitants. 5 3. Law enforcement vehicles of State or local 6 authorities when used in combination with red 7 oscillating, rotating or flashing lights. 8 4. Vehicles of local fire departments and State or 9 federal firefighting vehicles when used in combination 10 with red oscillating, rotating or flashing lights. 11 5. Vehicles which are designed and used exclusively 12 as ambulances or rescue vehicles when used in combination 13 with red oscillating, rotating or flashing lights; 14 furthermore, such lights shall not be lighted except when 15 responding to an emergency call. 16 (d) The use of a combination of amber and white 17 oscillating, rotating or flashing lights, whether lighted or 18 unlighted, is prohibited, except motor vehicles or equipment 19 of the State of Illinois, local authorities and contractors 20 may be so equipped; furthermore, such lights shall not be 21 lighted except while such vehicles are engaged in highway 22 maintenance or construction operations within the limits of 23 highway construction projects. 24 (e) All oscillating, rotating or flashing lights 25 referred to in this Section shall be of sufficient intensity, 26 when illuminated, to be visible at 500 feet in normal 27 sunlight. 28 (f) Nothing in this Section shall prohibit a 29 manufacturer of oscillating, rotating or flashing lights or 30 his representative from temporarily mounting such lights on a 31 vehicle for demonstration purposes only. 32 (g) Any person violating the provisions of subsections 33 (a), (b), (c) or (d) of this Section who without lawful 34 authority stops or detains or attempts to stop or detain -6- LRB9001951NTsbam 1 another person shall be guilty of a Class 4 felony. 2 (h) Except as provided in subsection (g) above, any 3 person violating the provisions of subsections (a) or (c) of 4 this Section shall be guilty of a Class A misdemeanor. 5 (Source: P.A. 88-58; 88-341; 88-670, eff. 12-2-94; 89-433, 6 eff. 12-15-95.) 7 (Text of Section after amendment by P.A. 89-507) 8 Sec. 12-215. Oscillating, rotating or flashing lights on 9 motor vehicles. Except as otherwise provided in this Code: 10 (a) The use of red or white oscillating, rotating or 11 flashing lights, whether lighted or unlighted, is prohibited 12 except on: 13 1. Law enforcement vehicles of State, Federal or 14 local authorities; 15 2. Tow trucks licensed in a state that requires 28 such lights; furthermore, such lights shall not be 29 lighted on any such tow truck while the tow truck is 30 operating in the State of Illinois. 31 (b) The use of amber oscillating, rotating or flashing 32 lights, whether lighted or unlighted, is prohibited except 33 on: 34 1. Vehicles that are equipped and used exclusively 21 as organ transport vehicles when used in combination with 22 red oscillating, rotating, or flashing lights; 23 furthermore, these lights shall only be lighted when the 24 transportation is declared an emergency by a member of 25 the transplant team or a representative of the organ 26 procurement organization. 27 (d) The use of a combination of amber and white 28 oscillating, rotating or flashing lights, whether lighted or 29 unlighted, is prohibited, except motor vehicles or equipment 30 of the State of Illinois, local authorities and contractors 31 may be so equipped; furthermore, such lights shall not be 32 lighted except while such vehicles are engaged in highway 33 maintenance or construction operations within the limits of 34 highway construction projects. -10- LRB9001951NTsbam 1 (e) All oscillating, rotating or flashing lights 2 referred to in this Section shall be of sufficient intensity, 3 when illuminated, to be visible at 500 feet in normal 4 sunlight. 5 (f) Nothing in this Section shall prohibit a 6 manufacturer of oscillating, rotating or flashing lights or 7 his representative from temporarily mounting such lights on a 8 vehicle for demonstration purposes only. 9 (g) Any person violating the provisions of subsections 10 (a), (b), (c) or (d) of this Section who without lawful 11 authority stops or detains or attempts to stop or detain 12 another person shall be guilty of a Class 4 felony. 13 (h) Except as provided in subsection (g) above, any 14 person violating the provisions of subsections (a) or (c) of 15 this Section shall be guilty of a Class A misdemeanor. 16 (Source: P.A. 88-58; 88-341; 88-670, eff. 12-2-94; 89-433, 17 eff. 12-15-95; 89-507, eff. 7-1-97.) 18 (625 ILCS 5/12-601) (from Ch. 95 1/2, par. 12-601) 19 (Text of Section before amendment by P.A. 89-687) 20 Sec. 12-601. Horns and warning devices. 21 (a) Every motor vehicle when operated upon a highway 22 shall be equipped with a horn in good working order and 23 capable of emitting sound audible under normal conditions 24 from a distance of not less than 200 feet, but no horn or 25 other warning device shall emit an unreasonable loud or harsh 26 sound or a whistle. The driver of a motor vehicle shall when 27 reasonably necessary to insure safe operation give audible 28 warning with his horn but shall not otherwise use such horn 29 when upon a highway. 30 (b) No vehicle shall be equipped with nor shall any 31 person use upon a vehicle any siren, whistle, or bell, except 32 as otherwise permitted in this section. Any authorized 33 emergency vehicle as defined in Chapter 1 of this Act may be -11- LRB9001951NTsbam 1 equipped with a siren, whistle, or bell, capable of emitting 2 sound audible under normal conditions from a distance of not 3 less than 500 feet, but such siren, whistle or bell, shall 4 not be used except when such vehicle is operated in response 5 to an emergency call or in the immediate pursuant of an 6 actual or suspected violator of the law in either of which 7 events the driver of such vehicle shall sound such siren, 8 whistle or bell, when necessary to warn pedestrians and other 9 drivers of the approach thereof. 10 (c) Trackless trolley coaches, as defined by Section 11 1-206 of this Code, may be equipped with a bell or bells in 12 lieu of a horn, and may, in addition to the requirements of 13 paragraph (a) of this Section, use a bell or bells for the 14 purpose of indicating arrival or departure at designated 15 stops during the hours of scheduled operation. 16 (Source: P.A. 89-345, eff. 1-1-96.) 17 (Text of Section after amendment by P.A. 89-687) 18 Sec. 12-601. No acceleration or delay. Where this Act 17 makes changes in a statute that is represented in this Act by 18 text that is not yet or no longer in effect (for example, a 19 Section represented by multiple versions), the use of that 20 text does not accelerate or delay the taking effect of (i) 21 the changes made by this Act or (ii) provisions derived from 22 any other Public Act.".
