LRB9002310MWpc SB228 Engrossed LRB9002310MWpc 1 AN ACT to create the Illinois Equal Benefit Opportunity 2 Act of 1997. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 1. Short title. This Act may be cited as the 6 Illinois Equal Benefit Opportunity Act of 1997. 7 Section 5. Benefits for couples. Notwithstanding any 8 law to the contrary, any unit of local government or school 9 district that grants benefits to same-sex couples, by any 10 criteria, must provide equal benefits to heterosexual couples 11 based on the same criteria. 12 Section 95. Home rule. Home rule units may not provide 13 benefits in a manner inconsistent with this Act. This 14 Section is a limitation under subsection (i) of Section 6 of 15 Article VII of the Illinois Constitution on the concurrent 16 exercise by home rule units of powers and functions exercised 17 by the State. 18 Section 97. The State Mandates Act is amended by adding 19 Section 8.21 as follows: 20 (30 ILCS 805/8.21 new) 21 Sec. 8.21. Exempt mandate. Notwithstanding Sections 6 22 and 8 of this Act, no reimbursement by the State is required 23 for the implementation of any mandate created by this 24 amendatory Act of 1997. 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.
