      625 ILCS 5/3-639 new
          Amends  the  Illinois  Vehicle  Code.   Creates   special
      license   plates  designated  as  State  Migratory  Waterfowl
      license plates.  Provides  for  an  additional  $40  fee  for
      original  issuance  and a $27 additional fee for each renewal
      period.  Provides that these fees shall be deposited into the
      State Migratory Waterfowl Stamp Fund  and  the  Secretary  of
      State  Special  License  Plate  Fund.   Provides  that  money
      deposited  into the State Migratory Waterfowl Stamp Fund from
      these plate fees shall be appropriated to the  Department  of
      Natural Resources for certain purposes.

 1        AN ACT concerning license plates, amending named Acts.
 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:
 4        Section 5.  The Wildlife  Code  is  amended  by  changing
 5    Section 1.29 as follows:
 6        (520 ILCS 5/1.29) (from Ch. 61, par. 1.29)
 7        Sec. 1.29.  Migratory Waterfowl Stamp Fund.
 8        (a)  There  is  hereby  created in the State Treasury the
 9    State Migratory Waterfowl Stamp Fund. All fees collected from
10    the  sale  of  State  Migratory  Waterfowl  Stamps  shall  be
11    deposited into this Fund.  These moneys shall be appropriated
12    to the Department for the following purposes:
13             (1)  50% of funds derived from  the  sale  of  State
14        migratory  waterfowl stamps and from deposits in the Fund
15        from the sale of State Migratory Waterfowl license plates
16        and 100% of all gifts, donations, grants and bequests  of
17        money  for the conservation and propagation of waterfowl,
18        for projects approved by the Department for  the  purpose
19        of  attracting  waterfowl  and improving public migratory
20        waterfowl areas within the State, and for payment of  the
21        costs  of  printing State migratory waterfowl stamps, the
22        expenses incurred  in  acquiring  State  waterfowl  stamp
23        designs  and  the  expenses  of producing reprints. These
24        projects  may  include  the   repair,   maintenance   and
25        operation  of  public  migratory  waterfowl areas only in
26        emergencies  as  determined  by  the  State  Duck   Stamp
27        Committee;  but none of the monies spent within the State
28        shall be used for administrative expenses.
29             (2)  25% of funds derived from  the  sale  of  State
30        migratory  waterfowl stamps and from deposits in the Fund
31        from the sale of State Migratory Waterfowl license plates

 1        will be turned over  by  the  Department  to  appropriate
 2        non-profit organizations for the development of waterfowl
 3        propagation  areas  within  the Dominion of Canada or the
 4        United States that specifically provide waterfowl for the
 5        Mississippi Flyway.
 6             (3)  25% of funds derived from  the  sale  of  State
 7        migratory  waterfowl stamps and from deposits in the Fund
 8        from the sale of State Migratory Waterfowl license plates
 9        shall be turned over by  the  Department  to  appropriate
10        non-profit    organizations    to   be   used   for   the
11        implementation of the North American Waterfowl Management
12        Plan.  These funds shall be used for the  development  of
13        waterfowl  areas  within  the  Dominion  of Canada or the
14        United States that specifically provide waterfowl for the
15        Mississippi Flyway.
16        (b)  Before turning over any funds under  the  provisions
17    of  paragraphs  (2)  and (3) of subsection (a) the Department
18    shall obtain evidence that the project is acceptable  to  the
19    appropriate governmental agency of the Dominion  of Canada or
20    the United States or of one of its Provinces or States having
21    jurisdiction  over  the  lands  and  waters  affected  by the
22    project, and shall consult those agencies and the State  Duck
23    Stamp Committee for approval before allocating funds.
24        (c)  The State Duck Stamp Committee shall consist of: (1)
25    The  State Waterfowl Biologist, (2) The Chief of the Wildlife
26    Resources Division or his designee, (3) The Chief of the Land
27    Management Division or his designee, (4)  The  Chief  of  the
28    Technical  Services  Division or his designee, and (5) Two or
29    more  at  large  representatives  from  statewide   waterfowl
30    organizations  appointed  by  the  Director.  The Committee's
31    duties shall be  to  review  and  recommend  all  Duck  Stamp
32    Projects  and  review and recommend all expenditures from the
33    State Migratory Waterfowl Stamp  Fund.  The  committee  shall
34    give due consideration to waterfowl projects that are readily

 1    available  to holders of the State Migratory Waterfowl Stamp,
 2    wherever they may live in Illinois.

 4        Section 10.  The Illinois  Vehicle  Code  is  amended  by
 5    adding Section 3-639 as follows:
 6        (625 ILCS 5/3-639 new)
 7        Sec. 3-639.  State Migratory Waterfowl license plate.
 8        (a)  The  Secretary,  upon receipt of an application made
 9    in the form prescribed by the Secretary of State,  may  issue
10    special  registration plates designated to be State Migratory
11    Waterfowl license plates.  The special  plates  issued  under
12    this  Section  shall be affixed only to passenger vehicles of
13    the first division, motor vehicles  of  the  second  division
14    weighing   not  more  than  8,000  pounds,  and  recreational
15    vehicles as defined by Section 1-169 of this  Code.    Plates
16    issued  under  this  Section  shall  expire  according to the
17    multi-year procedure established by Section 3-414.1  of  this
18    Code.
19        (b)  The  design  and color of the plates shall be wholly
20    within the discretion of the Secretary of State.  Appropriate
21    documentation,  as  determined  by   the   Secretary,   shall
22    accompany  the  application. The Secretary may, in his or her
23    discretion, allow the  plates  to  be  issued  as  vanity  or
24    personalized  plates  in  accordance  with Section 3-405.1 of
25    this Code.
26        (c)  An applicant shall be charged a $40 fee for original
27    issuance in addition to the appropriate registration fee,  if
28    applicable.   Of  this  fee,  $25 shall be deposited into the
29    State  Migratory  Waterfowl  Stamp  Fund  and  $15  shall  be
30    deposited into the Secretary of State Special  License  Plate
31    Fund, to be used by the Secretary of State to help defray the
32    administrative   processing  costs.   For  each  registration

 1    renewal period, a $27 fee, in  addition  to  the  appropriate
 2    registration  fee,  shall be charged.  Of this fee, $25 shall
 3    be deposited into the State Migratory  Waterfowl  Stamp  Fund
 4    and $2 shall be deposited into the Secretary of State Special
 5    License Plate Fund.
