90_SB0314 New Act 5 ILCS 80/4.17 new Creates the Telemedicine Licensure Act to require the licensure of non-resident physicians who seek to provide certain medical services to in-state physicians or patients through electronic means. LRB9002944DPcc LRB9002944DPcc 1 AN ACT to create the Telemedicine Licensure Act. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Title. This Act shall be known as the 5 Telemedicine Licensure Act. 6 Section 5. Telemedicine. 7 (a) In addition to any provisions of the Medical 8 Practice Act of 1987 defining the practice of medicine, that 9 practice includes any arrangement for compensation whereby a 10 physician, regardless of his or her residency, provides 11 through electronic or other means of communication diagnostic 12 services or treatment to any resident of the State of 13 Illinois. 14 (b) In the case of electronically transmitted 15 radiographic images, no out-of-state physician may provide, 16 pursuant to an ongoing, regular arrangement, official written 17 reports of his or her diagnostic evaluations of those images 18 to an in-state physician or patient without a license issued 19 under the Medical Practice Act of 1987. This subsection does 20 not apply to non-resident physicians who, while located 21 outside of this State, provide a second opinion regarding a 22 patient of a physician who is licensed under the Medical 23 Practice Act of 1987 and is located in this State. 24 Section 10. Jurisdiction. An out-of-state physician 25 providing diagnostic services or treatment to an Illinois 26 patient submits himself or herself to the jurisdiction of the 27 courts of this State as to any cause of action arising from 28 those services. 29 Section 15. Violations. Any person who is found by the -2- LRB9002944DPcc 1 Department of Professional Regulation to have violated a 2 provision of this Act is subject to the enforcement 3 provisions of the Medical Practice Act of 1987. 4 Section 75. The Regulatory Agency Sunset Act is amended 5 by adding Section 4.17 as follows: 6 (5 ILCS 80/4.17 new) 7 Sec. 4.17. Act repealed on January 1, 2008. The 8 following Act is repealed on January 1, 2008. 9 The Telemedicine Licensure Act. 10 Section 99. Effective date. This Act takes effect upon 11 becoming law.
