90_SB0324 35 ILCS 200/10-155 Amends the Property Tax Code. Deletes from the list of land that is considered open space for valuation purposes private golf courses. Effective immediately. SDS/bill0002/dgp SDS/bill00002/dgp 1 AN ACT to amend the Property Tax Code by changing Section 2 10-155. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Property Tax Code is amended by changing 6 Section 10-155 as follows: 7 (35 ILCS 200/10-155) 8 Sec. 10-155. Open space land; valuation. In all 9 counties, in addition to valuation as otherwise permitted by 10 law, land which is used for open space purposes and has been 11 so used for the 3 years immediately preceding the year in 12 which the assessment is made, upon application under Section 13 10-160, shall be valued on the basis of its fair cash value, 14 estimated at the price it would bring at a fair, voluntary 15 sale for use by the buyer for open space purposes. 16 Land is considered used for open space purposes if it is 17 more than 10 acres in area and: 18 (a) is actually and exclusively used for 19 maintaining or enhancing natural or scenic resources, 20 (b) protects air or streams or water supplies, 21 (c) promotes conservation of soil, wetlands, 22 beaches, or marshes, including ground cover or planted 23 perennial grasses, trees and shrubs and other natural 24 perennial growth, and including any body of water, 25 whether man-made or natural, 26 (d) conserves landscaped areas, such as publicor27privategolf courses, 28 (e) enhances the value to the public of abutting or 29 neighboring parks, forests, wildlife preserves, nature 30 reservations, sanctuaries, or other open spaces, or 31 (f) preserves historic sites. -2- SDS/bill00002/dgp 1 Land is not considered used for open space purposes if it 2 is used primarily for residential purposes or if it is used 3 as a private golf course. 4 (Source: P.A. 88-455; 89-137, eff. 1-1-96.) 5 Section 99. Effective date. This Act takes effect upon 6 becoming law.
