Amends the Criminal Code of 1961. Prohibits the
manufacture and sale of toy guns that are blue or black in
color and are similar in appearance, size, and shape to a
genuine handgun that a person could reasonably believe that
they are genuine handguns.

1 AN ACT to amend the Criminal Code of 1961 by adding
2 Article 24.6.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 adding Article 24.6 as follows:
7 (720 ILCS 5/Art. 24.6 heading new)
8 ARTICLE 24.6. TOY GUNS
9 (720 ILCS 5/24.6-5 new)
10 Sec. 24.6-5. Toy guns.
11 (a) It is unlawful to manufacture or sell a toy gun that
12 is blue or black in color and that a person could reasonably
13 believe is a genuine handgun.
14 (b) Sentence. A person who violates this Section is
15 guilty of a Class 4 felony.
16 (c) In this Section:
17 (1) "Handgun" has the meaning ascribed to it in
18 paragraph (2) of subsection (h) of Section 24-3 of this
19 Code.
20 (2) "Toy gun" means a facsimile or reproduction of
21 a handgun that is similar in appearance, size, and shape
22 to a genuine handgun.
