Amend Senate Bill 361 by replacing 3 the title with the following: 4 "AN ACT to amend the Probate Act of 1975 by changing 5 Section 25-2."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Probate Act of 1975 is amended by 9 changing Section 25-2 as follows: 10 (755 ILCS 5/25-2) (from Ch. 110 1/2, par. 25-2) 11 Sec. 25-2. When appointment of representative of ward 12 unnecessary.) Upon receiving an affidavit that the personal 13 estate of a ward does not exceed $10,000$5,000in value, 14 that no representative has been appointed for his estate and 15 that the affiant is a parent or a person standing in loco 16 parentis to the minor or is the spouse of the ward or, if 17 there is no spouse of the ward, that affiant is a relative 18 having the responsibility of the support of the person under 19 legal disability or ward, any person or corporation indebted 20 to or holding personal estate of the ward may pay the amount 21 of the indebtedness or deliver the personal estate to the -2- LRB9002775SMdvam01 1 affiant. In the same manner and upon like proof, any person 2 or corporation having the responsibility for the issuance or 3 transfer of stocks, bonds or other personal estate may issue 4 or transfer the stocks, bonds or other personal estate to or 5 in the name of the affiant. Upon the payment, delivery, 6 transfer or issuance pursuant to the affidavit, the person or 7 corporation is released to the same extent as if the payment, 8 delivery, transfer or issuance had been made to the legally 9 qualified representative of the ward and is not required to 10 see to the application or disposition of the property. 11 (Source: P.A. 83-706.) 12 Section 99. Effective date. This Act takes effect upon 13 becoming law.".
