Prohibits a person operating a watercraft from jumping the wake of another vessel within 150 feet. Provides that in order to operate a motorboat that has in tow a person on water skis, an aquaplane, or a similar device, the motorboat must have a capacity of at least 3 persons. Prohibits a person in a motorboat from sitting on the gunwales, tops of seat backs, or on the decking over the bow or stern while the motorboat is underway. Prohibits a livery from leasing a personal watercraft or speciality prop-craft to a person under 16 (instead of 12) years of age. LRB9000544NTsb SB496 Engrossed LRB9000544NTsb 1 AN ACT to amend the Boat Registration and Safety Act by 2 changing Sections 5-14 and 7-10 and adding Section 5-21. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Boat Registration and Safety Act is 6 amended by changing Sections 5-14 and 7-10 and by adding 7 Section 5-21 as follows: 8 (625 ILCS 45/5-14) (from Ch. 95 1/2, par. 315-9) 9 Sec. 5-14. Water Skiing. A. No person may operate a 10 motorboat thatwhichhas in tow or is otherwise assisting a 11 person on water skis, an aquaplane, or a similar contrivance,12 in or upon any waterway, unless thesuchmotorboat has a 13 capacity of at least 3 persons and is occupied by at least 2 14 competent persons. 15 B. No person may operate a motorboat having in tow or 16 otherwise be assisting a person on water skis, aquaplane or 17 similar contrivance from the period of one-half hour after 18 sunset to one-half hour before sunrise. This paragraph B does 19 not apply to motorboats used in duly authorized water ski 20 tournaments, competitions, exhibitions or trials therefor 21 where adequate lighting is provided. 22 C. All persons operating a motorboat having in tow or 23 otherwise assisting a person on water skis, aquaplane or 24 similar contrivance, must be careful and prudent in their 25 operation and keep at a reasonable distance from persons and 26 property so as not to endanger the life or property of any 27 person. 28 D. No person may operate or manipulate any vessel, tow 29 rope or other device by which the direction or location of 30 water skis, aquaplane, or similar device may be affected or 31 controlled in such a way as to cause the water skis, SB496 Engrossed -2- LRB9000544NTsb 1 aquaplane, or similar device, or any persons thereon to 2 collide with or strike against any person or object, except 3 ski jumps, buoys and like objects normally used in 4 competitive or recreational skiing. 5 (Source: P.A. 82-783.) 6 (625 ILCS 45/5-21 new) 7 Sec. 5-21. Passenger location. No person operating a 8 motorboat shall allow a person in the motorboat to ride or 9 sit on the gunwales, tops of seat backs, or on the decking 10 over the bow or stern of the motorboat while the motorboat is 11 underway, unless the person is inboard of guards or rails 12 provided on the motorboat to prevent passengers from being 13 lost overboard. 14 Nothing in this Section shall be construed to prohibit 15 entry upon the decking over the bow or stern of the motorboat 16 for the purpose of anchoring, mooring, or casting off or some 17 other necessary purpose nor to prohibit customary practices 18 while lawfully engaged in commercial fishing under the 19 provisions of the Fish and Aquatic Life Code or hunting and 20 trapping under the provisions of the Wildlife Code. 21 (625 ILCS 45/7-10) (from Ch. 95 1/2, par. 317-10) 22 Sec. 7-10. Unlawful rental of personal watercraft or 23 specialty prop-craft. 24 (a) A livery shall not lease, hire or rent a personal 25 watercraft or a specialty prop-craft to, or for operation by, 26 any person who is under 1612years of age. 27 (b) Any person convicted of violating this Section is 28 guilty of a Class A misdemeanor. 29 (Source: P.A. 87-798.)
