 6        To the President of the Senate and  the  Speaker  of  the
 7    House of Representatives:
 8        We,  the  conference  committee appointed to consider the
 9    differences  between  the  houses  in   relation   to   House
10    Amendments  Nos.  1  and  2 to Senate Bill 797, recommend the
11    following:
12        (1)  that the Senate concur in House Amendment Nos. 1 and
13    2; and
14        (2)  that Senate Bill 797, AS AMENDED, be further amended
15    by replacing the title with the following:
16        "AN ACT concerning transportation."; and
17    immediately below  the  enacting  clause,  by  inserting  the
18    following:
19        "Section  1.  Short  title.  This Act may be cited as the
20    O'Hare IAP Air Reserve Station Retrocession Act.
21        Section 1.5.  Authorization to accept retrocession.
22        (a)  Under the provisions of Section 2683 of Title 10  of
23    the  United  States  Code,  the  State of Illinois authorizes
24    acceptance of retrocession by the United States of America of
25    exclusive  legislative  jurisdiction,  to  the  extent   such
26    jurisdiction  has not previously been retroceded to the State
27    of  Illinois,  the  United   States   retaining   a   federal
28    proprietary  interest  only,  over  lands  consisting  of the
29    O'Hare IAP Air Reserve  Station,  located  in  Chicago,  Cook
30    County, Illinois, more particularly described as follows:
31             THAT  PART  OF THE SOUTH 1/2 OF SECTION 32, TOWNSHIP

33    Further, the State of Illinois accepts  retrocession  of  and
34    authorizes  acceptance  of  retrocession over all those lands
35    owned  by  the  United  States  that  may   subsequently   be

 1    identified  by the Department of the Air Force as part of the
 2    O'Hare IAP Air Reserve Station, although not included  within
 3    the  legal  description  contained in this subsection, to the
 4    extent  exclusive  jurisdiction  has  not   previously   been
 5    retroceded  to  the  State  of Illinois.  Any additional land
 6    over which the State  accepts  retrocession  of  jurisdiction
 7    shall  be  identified  in  a  notice filed by the Governor as
 8    provided in subsection (d).
 9        (b)  By  retaining  in  the  subject  lands   a   federal
10    proprietary interest only, there exists a right of the United
11    States to perform the functions delegated to it by the United
12    States  Constitution  and  directed by statutory enactment of
13    the United States  Congress  without  interference  from  any
14    source.   The State of Illinois may not impose its regulatory
15    power directly upon the United States and  may  not  tax  the
16    land  under  the  federal  proprietary interest; however, the
17    State of Illinois may tax a lessee's interest in the land  to
18    the extent State law permits.
19        (c)  Subject  to  subsection  (b),  the State of Illinois
20    accepts cession of exclusive federal legislative jurisdiction
21    from the United States, and the State of Illinois retains all
22    the legislative jurisdiction over the area it would have if a
23    private individual rather than the United  States  owned  the
24    land.
25        (d)  The  Governor of the State of Illinois is authorized
26    to  accept  the   retrocession   of   exclusive   legislative
27    jurisdiction  over  the  subject  lands by filing a notice of
28    acceptance with the Illinois Secretary of State.
29        (e)  Upon transfer by  deed  of  subject  lands,  or  any
30    portion  thereof,  by  the  United  States  of  America,  the
31    proprietary  interest  retained  by  the  United States shall
32    expire as to the particular property transferred.
33        Section 1.8.  The Civil Administrative Code  of  Illinois
34    is amended by adding Section 49.34 as follows:

 2        Sec. 49.34.  The Meigs Users Advisory Committee.
 3        (a)  The   Meigs   Users  Advisory  Committee  is  hereby
 4    created.   The  Meigs  Users  Advisory  Committee  shall   be
 5    composed of the following members: (i) 4 members appointed by
 6    the  Governor with the advice and consent of the Senate, 2 of
 7    whom shall have extensive knowledge of business and corporate
 8    aviation and 2 of whom  shall  have  extensive  knowledge  of
 9    general  aviation;  (ii)  4 members appointed by the Mayor of
10    the City  of  Chicago,  all  of  whom  shall  have  extensive
11    knowledge of general aviation; (iii) 4 members of the General
12    Assembly,  one each appointed by the President of the Senate,
13    the Speaker of the House, the Minority Leader of the  Senate,
14    and  the Minority Leader of the House; and (iv) the Secretary
15    of Transportation or his or her designee, who shall serve  as
16    Chairperson.   The  members appointed by the Governor and the
17    Mayor shall be users of Meigs Field.
18        (b) (1)  The Secretary of Transportation or  his  or  her
19        designee  shall  serve  during  the  Secretary's  term of
20        office.
21             (2)  Members  of  the  committee   appointed   under
22        subdivision  (a)(iii)  shall  serve  for  their  terms of
23        office, except that no such appointment shall  be  for  a
24        term  of more than 3 years. If a committee member who was
25        appointed under  subdivision  (a)(iii)  ceases  to  be  a
26        member  of the chamber of the General Assembly from which
27        the member was appointed, he or she shall be replaced  in
28        accordance with the method for filling vacancies.
29             (3)  The  initial  members  of the committee who are
30        appointed by the mayor of the City of  Chicago  shall  be
31        appointed  as  follows: one shall be appointed for a term
32        of one year, 2 shall be appointed for terms of  2  years,
33        and  one  shall be appointed for a term of 3 years. After
34        the expiration of the initial terms, all members  of  the
35        committee  who  are appointed by the mayor of the City of

 1        Chicago shall be appointed for terms of 3 years.
 2             (4)  The initial members of the  committee  who  are
 3        appointed  by the Governor shall be appointed as follows:
 4        one shall be appointed for a term of one year, one  shall
 5        be  appointed  for  a  term  of  2  years, and 2 shall be
 6        appointed for terms of 3 years. After the  expiration  of
 7        the  initial  terms, all members of the committee who are
 8        appointed by the Governor shall be appointed for terms of
 9        3 years.
10             (5)   Any member of the committee  is  eligible  for
11        reappointment  unless  he  or  she  no  longer  meets the
12        applicable qualifications. All members appointed to serve
13        on the  committee  shall  serve  until  their  respective
14        successors  are appointed and confirmed.  Vacancies shall
15        be filled in the same manner as original appointments.
16             (6)  If a vacancy in  membership  under  subdivision
17        (a)(i)  occurs  at  a  time  when  the  Senate  is not in
18        session, the Governor shall make a temporary  appointment
19        until  the  next  meeting  of  the Senate, when he or she
20        shall appoint, by and with the advice and consent of  the
21        Senate,   a  person  to  fill  that  membership  for  the
22        unexpired term.  If the Senate is not in session when the
23        initial appointments are made, those  appointments  shall
24        be made as in the case of vacancies.
25             (7)  The  committee  shall  be deemed established on
26        the date that a majority of the total number  of  members
27        has  been  appointed,  regardless of whether any of those
28        initial members are then serving pursuant to  appointment
29        and  confirmation  or  pursuant to temporary appointments
30        that  are  made  by  the  Governor  as  in  the  case  of
31        vacancies.
32        (c)  The Committee shall have the power  to  inspect  all
33    books,  records,  contracts,  financial data, agreements, and
34    documents relating to the operation and maintenance of  Meigs
35    Field,  including, without limitation, as-built plans for all

 1    buildings, runways, taxiways, and aprons, the control  tower,
 2    terminal,   and   all   related   facilities,   all  security
 3    agreements, fire protection agreements,  airline  agreements,
 4    FOB   agreements,   concessionaire  agreements,  rental/lease
 5    agreements, service agreements,  financial  data  and  budget
 6    reports  including revenues and expenditures, and any and all
 7    studies or plans regarding the land use of Meigs Field.
 8        (d)  The chairperson shall give notice to the members  of
 9    the  time  and  place  for every meeting.  The members of the
10    committee shall receive no compensation or  reimbursement  of
11    expenses  in  the  performance of their duties. The Committee
12    shall review and hold public hearings  on  any  proposals  or
13    actions   affecting   the  operation  of  Meigs  Field.   The
14    Committee shall issue recommendations to  the  Governor,  the
15    Mayor  of  the City of Chicago, and the General Assembly with
16    regard to these proposals or actions and  any  other  matters
17    concerning the operation of Meigs Field.".
