 1                    AMENDMENT TO SENATE BILL 852
 2        AMENDMENT NO.     .  Amend Senate Bill  852  on  page  3,
 3    line 23, by deleting "Fifty percent of the members"; and
 4    on  page  3,  line 24, by replacing "appointed and confirmed"
 5    with "Nine members"; and
 6    on page  12,  by  replacing  lines  5  through  32  with  the
 7    following:
 8        "Section  15.  The  Head  and  Spinal  Cord Injury Act is
 9    amended by changing Section 6 as follows:
10        (410 ILCS 515/6) (from Ch. 111 1/2, par. 7856)
11        (Text of Section taking effect July 1, 1997)
12        Sec. 6.  (a) There is hereby created the Advisory Council
13    on Spinal Cord and Head Injuries  within  the  Department  of
14    Human  Services.  The Council shall consist of 33 29 members.
15    Two members shall be appointed by each of the Speaker of  the
16    House  of  Representatives,  the President of the Senate, the
17    Minority Leader of  the  House  of  Representatives  and  the
18    Minority  Leader  of  the Senate for terms of 2 years, not to
19    exceed 3 consecutive terms. The remaining 25 21 members shall
20    be appointed by the Governor with the advice and  consent  of
21    the  Senate.  These 21 members shall determine by lot which 7

 1    are to have one-year terms, which 7 are to have 2-year terms,
 2    and which 7 are  to  have  3-year  terms.    Thereafter,  the
 3    successors to each of  These 25 21 members shall serve 3-year
 4    terms  and  until  their  successors  are  appointed  by  the
 5    Governor  with  the  advice  and  consent  of the Senate. The
 6    members  appointed  by   the   Governor   shall   include   2
 7    neurosurgeons,   2   orthopedic  surgeons,  2  rehabilitation
 8    specialists, one of whom  shall  be  a  registered  nurse,  4
 9    persons  with head injuries or family members of persons with
10    head injuries, 4 persons with spinal cord injuries or  family
11    members   of   persons   with   spinal   cord   injuries,   a
12    representative  of  an  Illinois college or university, and a
13    representative from health institutions or private  industry.
14    These  members shall not serve more than 2 consecutive 3-year
15    terms.  The Governor shall appoint one individual  from  each
16    of  the  following  entities  to  the  Council  as ex-officio
17    members: the unit of the Department of Human Services that is
18    responsible  for  the  administration   of   the   vocational
19    rehabilitation program, another unit within the Department of
20    Human  Services  that  provides services for individuals with
21    disabilities, the State Board of Education, the Department of
22    Public Health, the Department of Insurance, the Department of
23    Public Aid, the Division of Specialized Care for Children  of
24    the  University of Illinois, the Statewide Independent Living
25    Council,  and  the  State  Rehabilitation  Advisory  Council.
26    Ex-officio members are not subject to limit of 2  consecutive
27    3-year  terms. and a representative of each of the following:
28    (1)  an  Illinois   college   or   university,   (2)   health
29    institutions or private industry, (3) the Department of Human
30    Services  ,  (4)  the  State  Board  of  Education,  (5)  the
31    Department  of Public Health, (6)the Department of Insurance,
32    and (7) the Department of Public  Aid.   The  appointment  of
33    individuals  representing State agencies shall be conditioned
34    on their continued employment with their respective agencies.

 1        (b)  From  funds  appropriated  for  such  purpose,   the
 2    Department of Human Services shall provide to the Council the
 3    necessary  staff  and  expenses  to  carry out the duties and
 4    responsibilities assigned by the Council.  Such  staff  shall
 5    consist of a director and other support staff.
 6        (c)  Meetings  shall be held at least every 90 days or at
 7    the call of the Council chairman, who shall be elected by the
 8    Council.
 9        (d)  Each member shall be reimbursed for  reasonable  and
10    necessary  expenses  actually  incurred in the performance of
11    his official duties.
12        (e)  The Council shall adopt written procedures to govern
13    its activities. Consultants shall be provided for the Council
14    from appropriations made for such purpose.
15        (f)  The  Council  shall  make  recommendations  to   the
16    Governor  for  developing  and  administering a State plan to
17    provide services for spinal cord and head injured persons.
18        (g)  No member of the Council may participate in or  seek
19    to  influence a decision or vote of the Council if the member
20    would be directly involved with the matter  or  if  he  would
21    derive income from it.  A violation of this prohibition shall
22    be  grounds  for  a  person  to be removed as a member of the
23    Council by the Governor.
24        (h)  The Council shall:
25             (1)  promote   meetings   and   programs   for   the
26        discussion of reducing the debilitating effects of spinal
27        cord and head injuries  and  disseminate  information  in
28        cooperation  with  any other department, agency or entity
29        on  the  prevention,  evaluation,  care,  treatment   and
30        rehabilitation  of  persons  affected  by spinal cord and
31        head injuries;
32             (2)  study   and    review    current    prevention,
33        evaluation,    care,    treatment    and   rehabilitation
34        technologies  and  recommend   appropriate   preparation,

 1        training,  retraining  and  distribution  of manpower and
 2        resources in the provision of services to spinal cord and
 3        head  injured  persons   through   private   and   public
 4        residential    facilities,   day   programs   and   other
 5        specialized services;
 6             (3)  recommend   specific   methods,    means    and
 7        procedures which should be adopted to improve and upgrade
 8        the  State's  service delivery system for spinal cord and
 9        head injured citizens of this State;
10             (4)  participate  in  developing  and  disseminating
11        criteria and standards which may be required  for  future
12        funding  or  licensing  of  facilities,  day programs and
13        other specialized  services  for  spinal  cord  and  head
14        injured persons in this State; and
15             (5)  report annually to the Governor and the General
16        Assembly  on  its  activities,  and on the results of its
17        studies and the recommendations of the Council; and
18             (6)  be the advisory board for purposes  of  federal
19        programs regarding traumatic brain injury.
20        (i)  The  Department  of  Human  Services  may  accept on
21    behalf of the Council federal funds, gifts and donations from
22    individuals, private organizations and foundations,  and  any
23    other funds that may become available.
