1 AN ACT to amend the Illinois Public Aid Code by changing
2 Section 9-6.02.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 changing Section 9-6.02 as follows:

8 Sec. 9-6.02. Tests to determine literacy and English
9 language proficiency. Except for persons who are job ready,
10 the Illinois Department shall administer, or provide for the
11 administration of, standardized tests to determine the basic
12 literacy and English language proficiency level of persons
13 receiving benefits under Articles III, IV, V, VI or VII who
14 are required to participate in an employment, training or
15 education program under Sections 9-5 or 9-6 prior to
16 requiring such participation. Job ready persons who do not
17 obtain employment through job search shall be assessed and
18 tested before beginning another component. The results of
19 such tests shall be used to determine placement in an
20 employment, training or educational component. The Illinois
21 Department shall determine what constitutes an "English
22 language proficiency level" compatible with employability.
23 The Illinois Department shall define by rule "job ready" and
24 what constitutes a "basic literacy level".
