      615 ILCS 15/6             from Ch. 19, par. 126f
          Amends the Flood Control Act of 1945 to provide that  the
      Department  of  Natural Resources may lease or permit the use
      of the surplus waters at all Department owned dams and  lease
      or  permit  the use of any land for hydropower development or
      the power developed from it.  Removes provisions  authorizing
      the  Department  to  maintain  and  operate  power plants and
      structures for the  utilization  of  surplus  waters  and  to
      lease,  sell,  or  dispose of the power generated.  Effective
      immediately.

 1        AN ACT to amend the Flood Control Act of 1945 by changing
 2    Section 6.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The Flood Control Act of 1945 is amended by
 6    changing Section 6 as follows:
 7        (615 ILCS 15/6) (from Ch. 19, par. 126f)
 8        Sec. 6.  The Department of Natural Resources may lease or
 9    permit the use of, in whole or in part, the surplus waters at
10    all Department owned dams and lease or permit the use of,  in
11    whole  or  in  part,  any  land,  rights to land, or property
12    interests for hydropower development or the  power  developed
13    from  it  for  a  period  not  to exceed 50 years When in the
14    construction of  works  surplus  waters  are  available,  the
15    Department  of  Natural  Resources  when so authorized by the
16    General Assembly, may  maintain  and  operate  power  plants,
17    structures,  buildings  and appurtenances for the utilization
18    of the surplus waters,  and  may  lease,  sell  or  otherwise
19    dispose  of  the  whole  or  any  part of the power generated
20    thereby.

22        Section 99.  Effective date.  This Act takes effect  upon
23    becoming law.
