 1                    AMENDMENT TO SENATE BILL 934
 2        AMENDMENT NO.     .  Amend Senate Bill 934 on page  1  by
 3    inserting immediately below line 25 the following:
 4        "The   Commission   shall   determine   that  the  public
 5    convenience  and  necessity  requires  the  issuance   of   a
 6    certificate  for  a  common  carrier by pipeline that will be
 7    transporting  crude  oil   only   if   the   common   carrier
 8    demonstrates that:
 9             (1)  the   proposed  construction  is  necessary  to
10        provide adequate, reliable, safe, and  efficient  service
11        to  the  general  public  including,  but not limited to,
12        customers  and  citizen  consumers  of  the  product  and
13        by-products being transported for  purposes  of  end  use
14        consumption;
15             (2)  the  proposed  pipeline will be constructed and
16        operated  in  conformance  with  the   safety   standards
17        required    by    the   United   States   Department   of
18        Transportation, Office of Pipeline Safety;
19             (3)  the common carrier is  capable  of  efficiently
20        and  safely  managing  and  supervising  the construction
21        process and the operations of the proposed  pipeline  and
22        has taken sufficient action to ensure adequate, safe, and
23        efficient construction, supervision, and operation of the
24        pipeline;

 1             (4)  the  common  carrier  is  capable of financing,
 2        constructing,  and  operating  the  proposed  crude   oil
 3        pipeline   without   significant   adverse  financial  or
 4        environmental impact  on  the  landowners  and  residents
 5        along the proposed route of the pipeline;
 6             (5)  the    common    carrier   has   performed   an
 7        environmental impact assessment  regarding  the  proposed
 8        crude  oil  pipeline  and  will construct and operate the
 9        pipeline in  a  manner  that  conforms  to  all  existing
10        environmental  laws and regulations and will minimize the
11        pipeline's impact upon the environment; and
12             (6)  the facility will be constructed  and  operated
13        in  a  manner  that  will  protect  the  interests of the
14        landowners on whose property the pipeline is located  and
15        of  the  citizens  that  are  impacted  by  the  proposed
16        pipeline.".
