      30 ILCS 105/6z-42 new
          Amends the State Finance Act.  Creates the Excess Federal
      Grant Distributive Fund as a  special  fund  outside  of  the
      State  Treasury.   Provides  that  the  Treasurer  shall,  ex
      officio,  be custodian of the Fund.  Provides that all excess
      federal grant  moneys  shall  be  deposited  into  the  Fund.
      Defines "excess federal grant moneys" as those funds received
      by the State from a federal agency for grant or loan programs
      administered  by  any State department or agency and by units
      of local  government  where  (1)  the  funds  have  not  been
      appropriated   and   (2)  there  is  a  law,  regulation,  or
      intergovernmental agreement specifying how the funds shall be
      allocated to the units of local  government  that  administer
      the  program  at  the  local  level.  Provides that the State
      Department or agency  shall  certify  to  the  Treasurer  the
      disbursement of the stated sums of money to the named unit of
      local  government each month.  Provides that the State agency
      or department shall, within 10 days of  certification,  issue
      to  the  unit  of local government a statement indicating the
      additional amounts that will be available as a result of  the
      certification. Effective immediately.

 1        AN  ACT  to amend the State Finance Act by adding Section
 2    6z-42.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  State Finance Act is amended by adding
 6    Section 6z-42 as follows:

 8        Sec. 6z-42.  The Excess Federal Grant Distributive Fund.
 9        (a)  The  Excess  Federal  Grant  Distributive  Fund   is
10    created  as  a  special  trust  fund  outside  of  the  State
11    Treasury.    The   State  Treasurer  shall,  ex  officio,  be
12    custodian of the Fund.  Notwithstanding any  other  provision
13    of  law  to  the  contrary,  all  excess federal grant moneys
14    received in any fiscal year shall be deposited into the  Fund
15    and distributed as provided in this Section.  As used in this
16    Section,  "excess  federal grant moneys" means funds received
17    by the State from  any  federal  agency  for  grant  or  loan
18    programs  administered  by  any State department or agency at
19    the State level, and by units  of  local  government  on  the
20    local   level,  where;  (1)  the  funds  have  not  yet  been
21    appropriated by the General Assembly; and  (2)  there  is  in
22    effect  a  law,  regulation,  or  intergovernmental agreement
23    specifying the manner in which the funds shall  be  allocated
24    to the units of local government that administer the grant or
25    loan program at the local level.
26        (b)  On  or  before  the 25th day of each calendar month,
27    the  appropriate  department  or  agency  shall  prepare  and
28    certify to the Treasurer the authorization  for  disbursement
29    of  stated  sums of money to named units of local government.
30    The amount to be paid to each unit of local government  shall
31    be  the amount of excess federal grant moneys received during

 1    the preceding calendar month  to  which  the  unit  of  local
 2    government   is   entitled  under  the  law,  regulation,  or
 3    intergovernmental agreement specifying the  manner  in  which
 4    the   funds   shall  be  allocated  to  the  units  of  local
 5    government.
 6        When certifying the amount of monthly disbursement  to  a
 7    unit  of local government under this Section, the appropriate
 8    department or agency shall increase or decrease  that  amount
 9    by  an  amount  necessary  to  offset  any  misallocation  of
10    previous   disbursements.   The  State  Treasurer  is  hereby
11    authorized to make distributions as provided in this Section.
12        (c)  Whenever amounts are certified under  this  Section,
13    the  appropriate  State department or agency shall, within 10
14    days after the certification is made, issue to  the  unit  of
15    local   government  a  statement  indicating  the  additional
16    amounts that will be made available  to  the  unit  of  local
17    government  as  the  result  of the certification.  The State
18    department or agency and the unit of local government  shall,
19    without   unnecessary   delay,  amend  any  applicable  grant
20    agreement or other agreement to reflect the additional  funds
21    that are authorized for disbursement.
22        Section  99.  Effective date.  This Act takes effect upon
23    becoming law.
