LRB9001736DJcdA LRB9001736DJcdA 1 AN ACT to amend the Nursing Home Care Act by adding 2 Section 3-206.05. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Nursing Home Care Act is amended by 6 adding Section 3-206.05 as follows: 7 (210 ILCS 45/3-206.05 new) 8 Sec. 3-206.05. Restrictions on certain male staff; 9 penalty. 10 (a) A facility shall not permit a male nurse, male nurse 11 aide, male orderly, or male nurse technician to provide 12 personal care to a female resident of the facility except in 13 the presence of a female staff member of the facility. 14 (b) A facility shall not permit a male staff member of 15 the facility to provide services other than personal care, 16 such as maintenance and dietary services, to a female 17 resident of the facility except in the presence of a female 18 staff member of the facility. 19 (c) This Section does not apply to services provided by 20 a physician. 21 (d) A facility that violates subsection (a) or (b) 22 commits a business offense, and upon conviction of such an 23 offense the facility shall be fined an amount of at least 24 $10,000 and not more than $20,000. 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.
