Amends the Illinois Vehicle Code to prohibit a person
from operating, on a public roadway, a second division
vehicle registered for a gross weight of 8,000 pounds or less
while a person is in an unenclosed cargo area of the vehicle
and the vehicle is in motion, with exceptions.

1 AN ACT to amend the Illinois Vehicle Code by adding
2 Section 11-1429.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 adding Section 11-1429 as follows:
7 (625 ILCS 5/11-1429 new)
8 Sec. 11-1429. Passenger in cargo area prohibited. It is
9 unlawful for a person to operate, on a public roadway, a
10 second division vehicle registered for a gross weight of
11 8,000 pounds or less while a person is in an unenclosed cargo
12 area of the vehicle and the vehicle is in motion, except
13 during an emergency or if the vehicle is being used in a
14 parade. This Section does not apply to a person operating a
15 highway maintenance or construction vehicle or a vehicle used
16 exclusively for the vehicle owner's own agricultural,
17 horticultural, or livestock raising operations.
