90_SB1211 720 ILCS 5/12-10.1 new Amends the Criminal Code of 1961. Creates the offense of piercing the body of a minor. Provides that it is a Class C misdemeanor for a person to pierce or offer to pierce the body of a person under 18 years of age without written consent of the parent or legal guardian of that person for purposes of making a hole in the body to allow the injection of an object for ornamentation of the body. Exempts from the prohibition injections, incisions, acupuncture, or similar medical or dental procedure performed by a person authorized to perform that procedure. Exempts from the prohibition emancipated minors. Effective 30 days after becoming law. LRB9007257RCksD LRB9007257RCksD 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 12-10.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 12-10.1 as follows: 7 (720 ILCS 5/12-10.1 new) 8 Sec. 12-10.1. Piercing the body of a minor. 9 (a) Any person who pierces or offers to pierce the body 10 of a person under 18 years of age without written consent of 11 a parent or legal guardian of that person commits the offense 12 of piercing the body of a minor. 13 (b) Sentence. Piercing the body of a minor is a Class C 14 misdemeanor. 15 (c) Definition. As used in this Section, to "pierce" 16 means to make a hole in the body in order to insert or allow 17 the insertion of any ring, hoop, stud, or other object for 18 the purpose of ornamentation of the body. 19 (d) Exceptions. This Section shall not be construed in 20 any way to prohibit any injection, incision, acupuncture, or 21 similar medical or dental procedure performed by a licensed 22 health care professional or other person authorized to 23 perform that procedure. This Section does not apply to a 24 minor emancipated under the Juvenile Court Act of 1987 or the 25 Emancipation of Mature Minors Act or by marriage. 26 Section 99. Effective date. This Act takes effect 30 27 days after becoming law.
