1 AMENDMENT TO SENATE BILL 1307
2 AMENDMENT NO. . Amend Senate Bill 1307 by replacing
3 the title with the following:
4 "AN ACT concerning sanitation."; and
5 after Section 5, by inserting the following:
6 "Section 10. The Swimming Pool and Bathing Beach Act is
7 amended by adding Section 4.5 as follows:
8 (210 ILCS 125/4.5 new)
9 Sec. 4.5. Portable toilets.
10 (a) The Department of Public Health may not require
11 portable toilets or similar equipment at bathing beaches
12 owned by a not for profit property association or by a
13 municipality with a population under 10,000 unless there is a
14 demonstrable, present, continuing, and clear health risk.
15 (b) For purposes of this Section:
16 "Health risk" means an unreasonable and ongoing threat to
17 human health or safety posed by the physical,
18 bacteriological, or chemical conditions of the bathing
19 beach.".
