90_SB1483 New Act Creates the Retiree Health Benefit Security Act. Prohibits employers from reducing health coverage or changing the terms under which it is provided to a retiree at any time after the retiree begins receiving those benefits. LRB9011457JSmg LRB9011457JSmg 1 AN ACT concerning retiree health benefits. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Retiree Health Benefit Security Act. 6 Section 5. Definitions. As used in this Act: 7 "Employee" means a person who is covered by unemployment 8 insurance by his or her employer under the Unemployment 9 Insurance Act. 10 "Employee benefits" means services, compensation, or 11 remuneration other than wages or salary provided to an 12 employee or retiree as consideration for the employee's or 13 retiree's service. "Employee benefits" includes, but is not 14 limited to, health care, whether through insurance or 15 otherwise, life insurance, investment services, and pension 16 benefits. 17 "Employer" means a person who is subject to and required 18 to provide unemployment insurance to his or her employees 19 under the Unemployment Insurance Act. 20 "Retiree" means an employee who has ceased active 21 employment with an employer and is receiving health care 22 benefits from the employer or under a health care benefit 23 plan sponsored by the employer other than pursuant to the 24 Consolidated Omnibus Budget Reconciliation Act of 1974 or a 25 similar State law. 26 Section 10. Reduction in retiree health benefits 27 prohibited. An employer may not reduce health care benefit 28 coverage or change the terms under which it is provided to a 29 retiree at any time after the retiree begins receiving those 30 benefits. An employer may not reduce any other benefit -2- LRB9011457JSmg 1 provided to a retiree to compensate for the restrictions on 2 reducing a retiree's health care benefit without the 3 retiree's written consent.
