Provides that in a city or village that has prohibited the sale at retail of alcoholic liquor, upon the adoption of a resolution by the corporate authorities of the city or village calling for a referendum allowing the sale at retail of alcoholic liquor or upon the filing in the office of the clerk at least 90 days before an election in the city or village of a petition directed to the clerk containing the signatures of not less than 10% of the legal voters of the city or village to submit to the voters of the city or village the proposition to allow the sale at retail of alcoholic liquor, the clerk shall certify the proposition to the proper election officials. Provides that if a majority of the voters vote to allow the sale of alcoholic liquor, the city or village may then allow its sale. LRB9011346LDdv LRB9011346LDdv 1 AN ACT to amend the Liquor Control Act of 1934 by adding 2 Section 9-10.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Liquor Control Act of 1934 is amended by 6 adding Section 9-10.2 as follows: 7 (235 ILCS 5/9-10.2 new) 8 Sec. 9-10.2. Petition to allow retail sale in a city or 9 village. The provisions of this Section are intended to be 10 an alternative to the other referendum provisions in this 11 Article and shall be liberally construed. In a city or 12 village that has prohibited the sale of alcoholic liquor 13 within all or a part of its boundaries, upon the adoption of 14 a resolution by the corporate authorities of the city or 15 village calling for a referendum allowing the sale of 16 alcoholic liquor within its boundaries or upon the filing in 17 the office of the clerk at least 90 days before an election 18 in that city or village of a petition directed to the clerk 19 containing the signatures of not less than 10% of the legal 20 voters of the city or village to submit to the voters of the 21 city or village the proposition to allow the sale at retail 22 of alcoholic liquor, the clerk shall certify the proposition 23 to the proper election officials, who shall submit the 24 proposition at the election to the voters of the city or 25 village. The proposition shall be in the following form: 26 Shall the sale at retail of alcoholic liquor be allowed in 27 .....? The votes shall be recorded as "YES or "NO". If a 28 majority of the voters voting upon the proposition in a city 29 or village vote "YES", the city or village may then allow the 30 sale at retail of alcoholic liquor.
