      305 ILCS 5/9A-11.5 new
      305 ILCS 5/12-4.7d new
          Amends the  Illinois  Public  Aid  Code.   Provides  that
      unlicensed   child   care   providers  participating  in  the
      Department of Human Services child  care  assistance  program
      shall   authorize  the  Department  of  Children  and  Family
      Services to review the central register of cases of suspected
      child abuse or neglect to ascertain if the  provider  has  an
      indicated  report  of  abuse  or  neglect against him or her.
      Provides  that  the   Departments   shall   enter   into   an
      intergovernmental  agreement  to facilitate the Department of
      Human Services' requests for investigations.   Provides  that
      the  Department  shall  by  rule  determine when payment to a
      provider may be withheld if there is an indicated finding  in
      the Central Register.  Effective immediately.

 1        AN  ACT  to  amend the Illinois Public Aid Code by adding
 2    Sections 9A-11.5 and 12-4.7d.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois Public Aid Code is amended by
 6    adding Sections 9A-11.5 and 12-4.7d as follows:
 7        (305 ILCS 5/9A-11.5 new)
 8        Sec. 9A-11.5.   Investigate  child  care  providers.  Any
 9    child  care  provider  receiving  funds  from  the child care
10    assistance program under this Code who is not required to  be
11    licensed  under  the  Child  Care  Act  of  1969  shall, as a
12    condition of eligibility to participate  in  the  child  care
13    assistance program under this Code, authorize in writing on a
14    form  prescribed  by  the  Department  of Children and Family
15    Services,  an  investigation  of  the  Central  Register,  as
16    defined in the Abused and Neglected Child Reporting  Act,  to
17    ascertain  if  the child care provider has been determined to
18    be a perpetrator in an indicated report  of  child  abuse  or
19    neglect.
20        The  Department  of  Children  and  Family Services shall
21    conduct an investigation  of  the  Central  Register  at  the
22    Request  of the Department.  The Department shall request the
23    Department of Children and  Family  Services  to  conduct  an
24    investigation of the Central Register on a random basis.  The
25    Department  shall  by  rule  determine  when  payment  to  an
26    unlicensed child care provider may be withheld if there is an
27    indicated   finding  against  the  provider  in  the  Central
28    Register.

30        Sec.   12-4.7d.     Interagency    agreement    regarding

 1    investigation  of child care providers.  The Department shall
 2    enter  into  a  written  agreement  with  the  Department  of
 3    Children  and  Family  Services  which  shall   provide   for
 4    interagency  procedures  regarding requests by the Department
 5    that the Department of Children and Family  Services  conduct
 6    an  investigation  of the Central Register, as defined in the
 7    Abused and Neglected Child Reporting Act, to ascertain  if  a
 8    child  care provider who is not required to be licensed under
 9    the Child Care Act of 1969 and who is  participating  in  the
10    child  care  assistance  program  under  this  Code  has been
11    determined to be a perpetrator  in  an  indicated  report  of
12    child abuse or neglect.
13        Section  99.  Effective date.  This Act takes effect upon
14    becoming law.
