      35 ILCS 200/9-55
          Amends the Property Tax Code.  In the Section  concerning
      surveys  by owners, provides that the plat shall be certified
      and recorded before the issuance of any building  permit  for
      the lot or lots by a unit of local government responsible for
      issuing  the building permit, or except as otherwise provided
      by law.  Effective immediately.

 1        AN ACT to amend the Property Tax Code by changing Section
 2    9-55.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The Property Tax Code is amended by changing
 6    Section 9-55 as follows:
 7        (35 ILCS 200/9-55)
 8        Sec. 9-55.  Survey by owner. When a property  is  divided
 9    into   parcels   so  that  it  cannot  be  described  without
10    describing it by metes and bounds, it  is  the  duty  of  the
11    owner  to  have  the land surveyed and platted into lots. The
12    platting shall be in accord with the Plat Act. The plat shall
13    be certified and recorded.   Any  unit  of  local  government
14    responsible  for  issuing  building  permits  may require, by
15    ordinance, that the plat be certified and recorded before the
16    building permit is issued.  The  description of property,  in
17    accordance with the number and description in the plat, shall
18    be a valid description of the property described. However, no
19    plat  of  a subdivision, vacation or dedication of a tract of
20    land shall be  approved  by  a  city,  incorporated  town  or
21    village officer, nor shall any recorder record a plat, unless
22    a statement from the county clerk is endorsed thereon showing
23    that  he  or  she  finds  no delinquent general taxes, unpaid
24    current general  taxes,  delinquent  special  assessments  or
25    unpaid current special assessments against the tract of land.
26    No  officer  of  a  city,  village or incorporated town shall
27    approve the plat of a subdivision of a tract  of  land  until
28    all  deferred  installments  of  outstanding  unpaid  special
29    assessments  are  either  certified  as  paid  by  the proper
30    collector, or a division thereof is made in accord  with  the
31    proposed  subdivision  and  duly  approved  by the court that

 1    confirmed the special assessment.

 3        Section 99.  Effective date.  This Act takes effect  upon
 4    becoming law.
