90_SB1570 615 ILCS 90/7.1 from Ch. 19, par. 1208 Amends the Fox Waterway Agency Act to make a technical change. SRS90S0065PMaw SRS90S0065PMaw 1 AN ACT to amend the Fox Waterway Agency Act by changing 2 Section 7.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Fox Waterway Agency Act is amended by 6 changing Section 7.1 as follows: 7 (615 ILCS 90/7.1) (from Ch. 19, par. 1208) 8 Sec. 7.1. The Agency shall implement appropriate and 9 reasonable programs and adopt necessary and reasonable 10 ordinances and rules to improve and maintain the Chain O 11 Lakes - Fox River recreational waterway from the Wisconsin 12 State line to the Algonquin Dam for the purposes of boating, 13 sailing, canoeing, swimming, water skiing, rowing, 14 iceboating, fishing, hunting and other recreational uses, to 15 help prevent or control flooding of the waterway, to improve 16 recreational uses of the waterway, to prevent pollution and 17 otherwise improve the quality of the waterway, to promote 18 tourism, and to create and administer a procedure for 19 establishing restricted areas. In the case of a local 20 ordinance relating to the establishment of restricted areas, 21 speed limits, or other boating restrictions that is adopted 22 by another unit of local government and conflicts with an 23 Agency ordinance or rule, the Agency ordinance or rule shall 24 control even if the conflicting ordinance is more 25 restrictive, except that municipalities with corporate 26 boundaries that are both adjacent to and at the southern 27 terminus of the Agency's jurisdiction over the Fox River 28 shall retain the right to establish reasonable no-wake zones 29 within their corporate boundaries. The Agency may develop 30 programs and build projects to minimize pollution in the 31 watershed from otherwise entering the waterway. Prior to -2- SRS90S0065PMaw 1 establishing any restricted area, the Agency shall provide 21 2 days notice to any municipality in which the proposed area 3 borders upon or is located. Notice shall be filed with the 4 Clerk of the municipality. If such a municipality, by 5 resolution of the corporate authority of the municipality, 6 files an objection to the establishing of the proposed 7 restricted area, then that restricted area shall not be 8 approved except by a favorable vote of two-thirds of the 9 Chairman and Board of Directors. All Agency programs, 10 ordinances and rules shall be in conformance with the Rivers, 11 Lakes, and Streams Act. The Agency shall coordinate efforts 12 of State, federal and local governments to improve and 13 maintain the waterway. 14 (Source: P.A. 89-162, eff. 7-19-95.)
